State of Florida, County of Holmes. On this 24th day of July, A.D. One Thousand Nine Hundred and Nine, personally appeared before me, a Justice Peace in and for the county and State aforesaid, Benjamin Franklin Tadlock who, being duly sworn according to law is 73 years of age, having been born on the 16th day of October 1836, in the county of Randolph in the State of Alabama. That he is a bona fide citizen of the county of Holmes, State of Florida. That he has resided in the State of Florida continuously since the 13th day of September, 1865. That he is the identical person who enlisted in Geneva, Ala., under the name of Benjamin F. Tadlock, on the 12th day of April 1862, in Company H, Regiment 53 Alabama Calvary of the State of Alabama in the service of the Confederate States. (Here state whether the service claimed was in the Confederate States Army or in the service of a State.) and was Honorable Discharged at Augusta in the State of Georgia on the 4th day of May, 1865 on account of close of the War (Here state fully any other military service performed by the applicant.) I served through the war from the time I enlisted until I was discharged and paroled. (Here give date and place of capture, imprisonment, exchange or parole.) I was captured at Stiers berg, Carolina, was paroled at Augusta, Georgia. That I served faithfully until Honorable Discharged from the service of the Confederate States in the year 1865, and did not desert the service of the Confederate States nor take the oath of allegiance to the United States until after the surrender of the Confederate Armies. (Here state whereabouts at close of Civil War.) That I was in prison at Raleigh, North Carolina) That I do not own property, including real estate, personal property, stocks, bonds, mortgages or other collateral securities of any kind in this or any other State, nor does my wife own with me jointly or separately property to exceed in value the sum of five thousand dollars. That the following is a true an correct statement of all the property owned by me or by my wife, jointly and separately in this or any other State: Real estate located at: Homes County Florida 40 acres $200.00 Cattle, horses and other live stock: 1 mule $50.00 Personal property: $25.00 Stocks: Bonds: Mortgages, notes and other securities: None Total: $275.00 That I have heretofore granted a pension from the State of Florida under pension certificate No. 704 at the rate of $120.00 per annum. (Here state any disabilities, physical or mental.) from wound in on side of the head caused by explosion of a bomb shell, chronic sore leg from gun shot wound his mind is impaired. (Here state any wounds received, or loss of limbs and eyesight.) Wound in side of head, Chronic sore leg and blind in right eye caused by hurt on the head. Tadlock who is an applicant for a pension under the laws of Florida, and that from our own personal knowledge, and from the best information available, we believe that the applicant does not own property (including the property of his wife) to exceed in value the sum of $5,000.00, and that statements made by him relative to the value of his property are true and correct. Before me personally came D. G. Milton M.D., who being duly sworn, deposes and says that he is a physician; that he is a resident of the State and County aforesaid; that he personally knows B. F. Tadlock the applicant named in the foregoing application for a pension. This deponent further states that he has carefully examined the said applicant’s physical condition and finds: (Here state nature, character and extent of wounds, disease or disability. Please avoid technical terms.) That his mind and nervous system is wrecked from injury in back of head by bomb shell. He has chronic sore on left sec caused by gun show wound which very ________ impair the use of it. He has a very bad heart trouble. His eyesight is very poor and he is getting very feeble from age. This deponent further says that the said Benjamin F. Tadlock is permanently and totally disabled by reason of such injuries and disease. Milton M.D. Physician At a meeting of the State Board of Pensions held July 10th, 1907, at which the Governor, Comptroller and Treasure were present the following resolution was adopted: Resolved: That persons entitled to Pensions under the Laws of Florida, who apply for the amount allowed in the cases of total disability, must submit the affidavit of a reputable physician stating specifically the personal ailment and conditions that render the applicant entirely helpless and incapacitated, physically or mentally, for any work or business. Report of County Commissioners. We the undersigned, County Commissioners in and for the County of (left blank), Florida, do hereby report that at a meeting of the Board of County Commissioners held this day, the foregoing application of Benjamin F. Tadlock for a pension under the Laws of Florida, was investigated by us; that we are satisfied that the applicant does not own property (including the property of his wife) to exceeded the value of $5,000, and that the representations made in the petition and affidavits are true, and that a pension should be granted to the applicant. On this 28 day of May, 1899, personally appeared before me, Clerk of the Circuit Court in and for said county and State. B. F. Tadlock, age 61 years, who being by me duly sworn, declared he is the identical person who enlisted about the 12 day of April, 1862 in Captain J. E. P. Flournoy’s Company, county of Coffee, in the State of Ala, and that while in actual service in said company, H, 53rd Regiment Ala. Cav. of the State of Ala., and in the line of duty as such soldier at Huntsville and Atlanta State of GA, on or about the (left blank) day of June 1863 and July 1864, I was wounded in the left leg just above the ankle fracturing the bone and dislocating the muscle causing the left leg to be about two inches shorter then the right leg. Also while I was at Atlanta, GA., about July 1864 while in line of duty I received a wound on the left side of the head back of the left ear by the explosion of a shell causing partial impairment of the sight of left eye, also causes severe spells of the headache, I am totally disabled to perform manual labor, and that as the direct result of said injuries thus received in line of duty during the war, I am now unable to gain a livelihood by manual labor; that I have continuously since January 1st 1880, been a citizen of Florida; that neither I, nor my wife, nor both combined own real and personal property to the value of $600 in this or any other State, and have not purposely disposed of our property for the purpose of availing ourselves of the provisions of the pension laws of Florida; that I am not otherwise enabled, or in a position to ear, and have no income from any source sufficient for, a livelihood, and that I have no children or other relation able so to do, and whose legal duty it is to support me, and that I never deserted the Confederate service, and that I receive a pension from no other source. Tadlock the above applicant for pension during the Civil Wsar of 1861 – 1865, that we served with him in H Capt. J.E.P. Flournoy’s Company, H 53rd Ala. Cav. Regiment, and know of our own knowledge that he did receive the injuries set forth in the above application at the time and place claimed, and that the disability there from claimed to exist does exist, and that he never deserted the Confederate Army. We the undersigned physicians, residents of the State and county aforesaid, do solemnly swear that we have carefully examined B.F. Tadlock who is personally known to us to be the person above applying for a pension under the laws of Florida, and find that he was wounded in left leg fracturing both bones of said leg, the left leg is shorter than right leg and muscles of left leg are atrophied and perished away. Scull was fractured the occipital bone of head leaving a large scar and bone is sunk in where the fracture is. We advise that claimant should fare a ¾ rating. The children of parents who are unable to support themselves, shall be required to make provision for their support. 2078. On information file before the Justice of the Peace of the proper district by any person, whomsoever, stating that certain persons have made no adequate provision for their father and mother, or either of them, the Justice shall cause a summons to be issued to said parties, and evidence to be taken as to the truth of the facts stated in the information, and if the same shall be found true, after a fair trial in which the defendants shall have the right to be heard by counsel, the Justice shall issue an order making an assessment of the said children for such amount as shall be necessary for the support of their parents. 2079. Said order shall carry with it the right of enforcement by execution, and shall have the force and effect of a writ of garnishment on the wages of such children, and shall further provide for the person to whom and the manner in which the money assessed therein shall be paid. Honorable Sir: I hereby make application for a raise in my pension being unable to make a living by manual labor, and enclose certificate and affidavit from 3 of the best physicians here. One of which is a licensed physician of Fla. (Dr. R. L. Justice) and his license is recorded in Book IV Page 31, Records of _____ at Bonifay, Fla. Geneva County Geneva, Alabama To the Honorable Board of Pensions of Florida: We the undersigned Physicians have carefully examined Benjamin Franklin Tadlock and find him unabled to do manual labor on account of the following physical conditions. Old age being 72 years old. Loss of sight of left eye and poor sight in right eye caused from wound on left side of his head. Said wound he claims was received by a part of a bomb shell in the bombardment of Atlanta, Ga. Also suffering with chronic ulcers on both legs from peniostitis, caused he claims that left leg was broken by a Minnie ball in battle at Huntsville, Ala. All these wounds he claims occurred while in the Confederate Services and all these conditions render him unabled to make a living for himself and wife. Sworn to and subscribed Robt. L. Justice M.
