Walter died in the mid to late 1830’s (no grave found yet) and Rebecca is listed on the 1840 Calhoun Co., Fl Census in St. Joseph as Head of Household, aged 50-60. Rebecca married a 2nd time in the latter part of the 1840’s to ______ DEVAUGHN/DEVAUN, who must have died very shortly after the marriage because she is listed as Rebecca Devaun & living in the household of her son, John DAVIS on the 1850 Jackson Co., Fl Census, page 320. She died intestate while visiting her son, Ellis Fairbanks DAVIS, in Iola, Calhoun County, Fl. in Aug. 1852 - the attending Physcian was a Dr. Lewis. The Estate Records are in the Marianna, Jackson Co., Fl. Court House - they list these 9 children as hers: 1. John, 2. Elizabeth, 3. Susannah, 4. James Henry, 5. Ellis Fairbanks, 6. Joseph C., 7. Samuel W., 8. Almira/Elmira, 9. George W. James Henry and Elmira moved to Houston Co., Texas in the late 1840’s and I have no further information on them, other than Elmira married Richard D. Westcott, probably in either Calhoun or Jackson county before moving to Texas, and James Henry’s wife was Eliza or Elizabeth. The other children all stayed in the Jackson & Calhoun county areas and raised their families there. Rebecca’s mother was Elizabeth ________ & _________ HARVEY of Effingham Co., GA. Elizabeth died ca 1835 in Jackson Co., FL, and her grandson, John DAVIS, administered her estate along with his mother’s, Rebecca, in late 1852 & early 1853. =============================================================== State of Florida, County of Jackson } Before me, Frederick R. The petition of John Davis would respectfully state that his grandmother, Elizabeth Harvey, died in this State about the year 1835, and your petitioner is informed and believes, intestate, and possessed of certain slaves, some of which are now in this County. That her heirs at law are the children of your petitioner's mother; William Harvey, living in the State of Georgia, of whom your petitioner is assignee; Susan Bragg, of whom your petitioner is assignee; Martha, who intermarried with John Sheffield, whose interest has been assigned to a son of Ellis Davis; and Polly (Mary), who intermarried with James Martin. Your petitioner, as the eldest of the heirs on the part of his mother, residing in this State, and as the assignee of two other slaves of said estate, prays your Honor to grant him letters of administration on said estate. That said slaves were in the possession of your petitioner's mother, whose residence at the time of her death was in Jackson County, and that your petitioner has, with the consent and by direction of his mother, had the control and management of said slaves for the last two years. Roulhac, Judge Probate of Jackson County, Florida I beg leave to state when I made the above distribution of the Estate of Elizabeth Harvey, I believed that the heirs of Mary (Polly) Martin, formerly Mary Harvey, were in being and would claim their share of said Estate, but I have advertised as the Law directs and waited three months since the expiration of said advertisement, and yet no claimaints have come forward, and I am inclined to believe that the said representatives of said Mary Martin are all dead. Therefore, I pray an order of your Court directing me what disposition to make of the amount now remaining in my hand. And I also ask to be discharged from further administration of said Estate.
