Before the Honorable J. B. Milam County Judge of Lake County Sitting in Probate In the matter of the Estate of R. T. McEwen, deceased. Petition of Mary P. McEwen to have a childs part assigned her. 1st The Petition of Mary P. McEwen, shows that she is the Widow of R. T. McEwen, deceased who resided in Lake County Florida at the time of and long prior to his death. 2nd That on the 6th day of July 1897, and within twelve months after the granting of Letters of Administration, she filed her written notice in the Honorable Court of her election to take a childs part of the Real Estate of her Husband R. T. McEwen, in lieu of her right of dower in said Estate. 3rd That the said R. T. McEwen left surviving him Mary P. McEwen, S. F. Stokes, James J. McEwen, Mrs. Mary A. Brantly, and heirs of Mrs. G. A. Fortson. 4th Your Petitioner further shows that a period of over one month has elapsed since the said Widow filed her election to take a childs part of the Real Estate of her said husband. 5th That the lands teniments and hereditiments in which said Widow claims a childs part are as follows to Wit. W1/2 less S1/2 of SE1/4 of NW1/4 of NW1/4 and less lots 1, 2, 3 in E1/2 of SW1/4 and S1/2 of SE1/4 Sec 20 TP 18 R 27. E1/2 of NE1/4 – E1/2 of SE1/4 – SW1/4 SE1/4 E1/2 of NW1/4 of SE1/4 – E1/2 of SW1/4 of NE1/4 Sec 19 TP18 R 27. E 8 acres of SE1/4 of SE1/4 of SW1/4 of SW1/4 of SW1/4 SW1/4 of SE1/4 Sec 1 TP 18 R 26. Your Honorable Court, is respectfully petitioned to take such other and further proceedings as are usual in such cases, and that a childs part may be set appart for said Widow discribed by metes and bounds of all the afore discribed lands belonging to the Estate of the said R. Milam, County Judge of Lake County, Sitting in Probate In the Matter of the petition of Mary P. McEwen, Widow of Robert T. McEwen, to have a childs part assigned her. On this day this cause came on to be heard upon the petition of Mary P. McEwen, Widow of Robert T. McEwen, to have a childs part assigned her, And it appearing to the Court that the said petitioner, has filed her election to take a childs part in lieu of dower, and she is the step Grand Mother of the following named minor children Eugene B. Fortson Age 20 Years, Albert S. Fortson, age 18ys Allice Fortson age 14 ys, And that proper notice has been given and that there is no one present to represent the interest of said Minors. Thereupon in consideration thereof it is ordered that A. V. Hamill of Tavares, be and is hereby appointed Guardian ad litem of the said Minor children.
