Smith In the name of God -Amen- I, Mary E. Smith of the County of Leon and State of Florida being of sound mind and calling to mind the frailty and uncertainty of human life, and being desirous of settling my worldly affairs, And directing how the Estates with which it has pleased God to bless me shall be disposed of after my decease, while I have strength and capacity so to do, do make and publish this my last will and testament hereby revoking and making null and void all other last wills and testaments by me heretofore made. And First I commend my immortal being to him who gave it, And my body to the earth to be buried with little expense or ostentation by my executors hereinafter named. And as to my worldly estate and all the property real personal or mixed of which I shall die seized or possessed or to which I shall be entitled at the time of my decease, I devise bequeath, and dispose thereof in the manner following. To wit: Second My will is, That all my just debts and funeral charges shall by my executor hereinafter named be paid out of my Estate as soon after my decease as shall by him be found convenient. Third I give devise and bequeath unto my beloved brother Robert L. Smith the sum of Five dollars in money to be paid to him out of my estate by my executor hereinafter named within six months after my decease to be for the sole use of himself and his heirs. Fourth. I give devise and bequeath all the rest residue and remainder of my personal estate of every kind name and nature whatsoever to my beloved brother Herbert P. Smith. And I do also give devise and bequeath to my said brother Herbert P. Smith all of my undivided interest right and title to the following tract of land situate being and lying in Leon County Florida together with all the hereditaments and appurtenances thereunto belonging or in anywise appertaining and described as follows. To wit. South East Quarter and East half of South West Quarter of Section Seven, Township two North Range two East containing two hundred and forty acres. To have and to hold the premises above described and personal property to said Herbert P. Smith his heirs and assigns forever. And Lastly, I do hereby appoint my said brother Herbert P. Smith sole executor of this my last will and Testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal This 18th day of January in the year of our Lord One Thousand nine hundred and ten (1910). Mary E. Smith, deceased - Leon County Personally appeared before me, B.A. Meginniss County Judge for the County aforesaid, D. F. Gramling one of the subscribing witnesses to the foregoing paper writing, who, being duly sworn, declares and says that Mary E. Smith did, in his presence, sign, seal and publish the foregoing paper writing as and for her last will and testament; and that he, the said witness, signed the same as a subscribing witness, at the special request of said testator; and that the said testator signed said paper writing in the presence of J. B. Conner and N. M. Isler, and this affiant, who likewise signed said paper writing, as subscribing witnesses, in the presence and at the request of the testator, and also in the presence of this affiant, and that he verily believes said paper writing to be the true Last Will and Testament of said testator. Smith, deceased, late of said County having been duly proven before me in due form of law by D. F. Gramling, one of the subscribing witnesses thereto, It is thereupon ordered that the same be allowed as proved and admitted to record. Done and ordered this 25th day of February, A.D. 1910. (Seal) B.
