Potts State of Florida Marion County] We the commissioners appointed to partition the real estate of Jenkins W. Potts and James E. Potts late of Marion County do divide the south half of section 27 twenty seven and the southwest 44 of the swest 44 of section 26 twenty six township 12 twelve range 19 nineteen by an east and west line running through the entire of said land and set aside this dower of Rebecca C. Potts widow of Jenkins W. Potts as the north west 44 of the south east 44 and 1/4 and the north west 1/2 of the south east 1/4 of the south east 1/4 of section 27 twenty seven township 12 twelve range 19 nineteen containing sixty acres done on this 24th day of December AD 1866. Priest sheriff Marion County, You are hereby commanded to summon five discreet freeholders connected with the _____ neither by affinity nor consanguinity and entirely dis interested and to whom you shall administer an oath as provided for by the statue page 186, you casue said Rebecca C. Potts to be a divide with one third part of the following: _____ tract of land comprising the Real estate of said Jenkins W. Potts deceased, biz the south half of section 27 township 12, range 9 containing three hundred twenty acres more or less. R. Mann JP MCFL State of Florida, County of Marion} Know all men by these presents that I Mrs. LEurena Potts, Administratrix of the Estate of James E. Potts deceased and ___Jesse Williams, Retus J. William of the county and state aforesaid, are held and firmly bound unto William T. Harrison, Judge of Probates for the county of Marion and State of Florida and his successors in Office, in the sum of ten thousand dollars lawful money of the Confederate States of America, for the payment of which well and truly to be made, we bind ourselves, our heirs, executors and administrators. The condition of the above obligation is such that whereas the said LEurena Potts, has been appointed administratrix of the estate of James Potts, deceased. Now, if the said Administratrix shall well and truly executre and perform the duties as administratrix as aforesaid, according to law, then this obligation to be null and void, otherwise, to remain in full force and virtue In witness whereof, we have hereunto set our hands and seals this 10 day of July AD 1863 taken and approved of by me D. Capplemen, sheriff of said county was appointed by your Honor Admr. on the Estate of Petitioner deceased ______ Jas E. Potts, she waiving her right in his favor, _dcy said admr might pay all the debts of said estate with the sale of ___ or Negroes, 3 ___ it is mattor of complaint of your petitioner, that said admr has need _ly sold Jo, a very valuable male slave, and that without the authority of __- __ or the __ formers of law in such case made and provided your petitioner now prays an order of ___ viewing the administrators granted to said D. B. Cappleman, sheriff,a nd also __ order making null and void the sale of said male slave named Jo. Your petitioner asks your Hon. court to trant the administrations to said petition and so nice your petitioner ever pray Lieureny Potts Additional Comments: Jenkins Wilson Potts & James Edmondson Potts were brothers that bought land together. Both died during the Civil War. This is the two widows trying to divide the land.
