That she is the lawful widow of Milton Pyles Tribble who enlisted under the name of Milton Pyles Tribble on the 14th day of April, 1861, in Company A Third (Infantry) Regiment of the State of South Carolina and who was honorably discharged at the surrender, 1865, on account of surrender of Gen. Lee’s Army. (Here give complete statement of other service, if any.) That he also served as a member of Co. E, 7th Cavalry. (State here if husband drew a pension, and when.) Milton Pyles Tribble drew a pension from the State of South Carolina for about one year prior to his death on Jan. 15, 1909. The records show that (sic) The records show that M. P. Tribble, not borne as Milton Tribble, private, Company A, 3rd Regiment South Carolina Infantry, Confederate States Army, was enrolled April 14, 1861, at Laurens, age 20 years. He was discharged October 14, 1861. The records also show that one M. P. Tribble, private, Company C, Cavalry Battalion, Holcombe Legion, South Carolina, Confederate States Army, enlisted July 1, 1862, at Camp Williams. This battalion was increased to a regiment about March 16, 1864, and became Company E, 7th Regiment South Carolina Cavalry. Muster roll of that company for March 1 to August 31, 1864, only roll on file, shows him present. He was paroled April 9, 1865, at Appomattox Court House, Virginia. James F. Dear Mr. Lee: With further reference to pension granted to Mary Y. Tribble by the 1935 Legislature, Senate Bill No. 215; I had a letter from you under date of September 18, in reference to above subject, and also another letter under of October 16th, wherein you promised to take this matter up with the Board and advise me in reference to paying the back pension due Mrs. Tribble under this act. This act grants her a pension commencing January 1, 1935, and I do not see why the Board should arbitrarily refuse to pay her this back money, and do not believe the Board would do so if called to their attention. As I have previously written you, this old lady needs this money and needs it now before she dies, and I will thank you very much to call this matter to the attention of the Board and have voucher sent her for the back pay. Under this law she should have gone on the pension rolls as of date, January 1, 1935, while as a matter of fact, you only sent her pension from the effective date of the law. You wrote me under date of September 18, that the matter would be referred to the pension board and that you would write me again in the next week or two. To date I have not heard anything further in reference to this matter and will thank you to advise. The law clearly states that she should go on the pension roll as of date, January 1, 1935, and she needs this money. D. 1935, after moving to, and becoming a citizen of the State of Florida, which she did, upon being advised by those who might be supposed to know that she could continue to draw her pension from the State of South Carolina until she became eligible to receive a pension from the State of Florida, or until she had been a resident of the State of Florida for eight (8) years; and WHEREAS, she being now about eighty-five (85) years of age, and in need of the pension; therefore, BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: SECTION 1. That the State Board of Pensions be, and it is hereby authorized and directed to place the name of Mrs. Mary Y. Tribble on the pension roll of this State, as of date, January 1st, A. D. 1935, to be paid a pension at the same rate and in the same manner that other pensioners of the State are paid, commencing as of that date. SECTION 2. Provided that nothing in this Act shall be construed to prohibit the right of the State Pension Board under the General law of 1923 to remove the name of the pensioner from the pension roll, if, after investigation such Board shall find that the alleged soldier upon whose service the pension is based, did not render service during the war between the States, such as would entitle him to receive a pension or that he deserted the service. SECTION 3. This act shall take effect immediately upon its becoming a law. Became a law without the Governor’s approval. May 20, 1935. Bailey with the Pension Board of Florida that you are not entitled to draw a pension from South Carolina. As this is true you will not be carried on the Pension Roll in this County for 1935. I also notice that you were later put on the Pension Roll for 1934 in this County through error of Edna E. Dodd, my predecessor, and that you have received three installments of the pension. The fourth installment of the pension will be mailed to you as it is already on the 1934 roll, but you will not receive a pension in 1935. No official in this State has any authority to give permission to a person who removes from the State to continue to receive a pension. If Mrs. Tribble has lived in your State since September 18, 1925, it seems to me that she has thoroughly established her citizenship in Florida and her pension from this State should have ceased after she had been there one year. The Comptroller General, who has charge of the Pension Department of this State, has requested me to send a copy of my letter to you to the probate judge of Anderson County where Mrs. Tribble formerly resided and upon his striking Mrs. Tribble’s name from his list of pensioners in Anderson County, she will then be eligible to draw the Florida pension under your regulations.
