My dear Joe:- Replying to your letter with reference to pension claim #8119 and 11388 filed by Mr William Tucker of Ocala, I beg to say that Mr Tucker’s first claim was very imperfect, both his witnesses stating they did not know where he was at the close of the war, or whether he was discharged prior to the close of the war or not. Mr Tucker was advised that his proof was not satisfactory. In June last he filed a second application and one of the men, J. D. Kersey, who signed his former application and who swore that he did not know whether Mr Tucker served until the close of the war or not and who did not know whether he was discharged or not, swears in the second application that he with his command at the surrender and was paroled. In the former application this witness states that he was at home on a furlough himself at the close of the war and in the second he swears that he was at Macon Georgia where they were paroled. The Custodian of the Records of Georgia says that this regiment surrendered at Goldsboro, N.C. The Board does not allow pensions to any Reserves or Home Guards of any state except Florida, the law provides for pensions to any person who enlisted and served in the Page 048 -2- Bell. service of the Confederate States or of this state, including home guards and reserves. Home guards and reserves and militia were in the service of the state and were not in the Confederate Army, and cannot be legally pensioned under our law. We are now in correspondence with the Georgia Department and it is possible that the fact can be established that toward the last of the war the Reserve Regiment of Georgia were mustered into the Confederate service, but until this is clearly established such application will be rejected. Mr. Wilkins of Anthony, (R.H.Wilkins) was on the roll under the former law and even if he had been a Reserve, which his application does not show, he would still remain on the roll under section V. which provided that all persons on the roll under the former law should be retained. Mr Hall is not on the roll at all. His claim was returned to the clerk of the court for better proof and has not been returned to this office. Mr Tucker should know that each application must stand on its own merits and is considered without reference to any other claim. His applications were rejected upon the grounds of unsatisfactory proof of service and because he belonged to a branch of service whose right to pensions under our law has not been established. In addition to the foregoing the records of the War Department contain no record of his service after October 1864 nor is there any record of his capture or parole. I regret to have to say we have no rolls of any of the Georgia Reserves. They were all captuered (sic) by Grant at Richmond and sent to Washington where they now are and the Secretary of War refuses to let us have copies. I know of my own knowledge that the third Georgia Reserves was regularly mustered into the Confederate service and did service in Georgia and South Carolina but I have no record of the fact.
