D. One Thousand Nine Hundred and Twenty-six personally appeared before me, a notary public in and for the county and State aforesaid, John Irvin who, being duly sworn according to law, declares that he is 81 years of age, having been born on the 4th day of July, 1845, in the county of Covington, in the State of Alabama. That he is a bona fide citizen of the county of Okaloosa, State of Florida. That he has resided in the State of Florida continuously since the 1st day of March, 1901. That he is the identical person who enlisted at Andalusia, Alabama, under the name of John Irvin, on the 2nd day of April, 1862, in Company Gantt's, transferred to Col. Coleman's of the state of Alabama in the service of the Confederate States Army and who was HONORABLY DISCHARGED at Mobile, in the State of Alabama, on the 8th day of November, 1862 on account of physical disability from exposure and disease contracted while in actual line of service and duty. That I served faithfully until HONORABLY DISCHARGED from the service of the Confederate States Army in the year 1862, and did not desert the service of the Confederate States Army nor take the oath of allegiance to the United States until after the surrender of the Confederate Armies. (Here state whereabouts at close of Civil War.) That I was home Andalusia, Alabama, unable to serve in Confederate Army or any other army. That I have not heretofore applied for a pension from the State of Florida but the proof contained herein is (Here state any disabilities, physical or mental.) A transcript from the muster roll from the adjutant's generals office at Washington, D. C. to establish the service claimed - which I hereto attach and make a part hereof - I am now blind in both eyes. That my postoffice address is Niceville, County of Okaloosa, State of Florida. P. Reese, President, U. D. C. Pensacola Chapter, No. 298 Pensacola, Fla. The name John Irvin appears on the only muster roll on file in this office for Gantt's Co. 4 Ala. Vol. Militia, C. S. A., dated Apr. 2 to June 25, 1862, on which roll he is shown to have enlisted Apr. 2, 1862 at Andalusia, Ala. He was transferred to Col. Coleman's Reg't. for War May 10, 1862 by order Genl. Forney. The rolls on file for Co. I, 40 Reg't. Ala. Inf. C. S. A., (Col Coleman Reg't.) cover the period, July 1 to Dec. 31, 1862 but the name John Irvin has not been found thereon. A Surgeon certificate for discharge on file, dated Aug. 8, 1862, signed by the Surgeon of the 40 Reg't. Ala. Inf. recommends his discharge for physical disability, and is shown to have been approved, but date of discharge is not shown. The above is the only man of that name on file of any Ala. C. S. Hoping that the board of pensions will act on it at an early date as applicant is very old, infirm and weak and blind and may not can enjoy it very longer, I am Yours very truly, Purl G. War Record show is name on file "dated April 2, to Jun 25, 1862, on which roll he is shown to have enlisted April 2nd, 1862, at Andalusia, Ala. He was transferred to Col. Coleman's Regt. May 10, 1862. *** A Surgeon certificate for discharge on file, dated Aug. 8, 1862, signed by the Surgeon of the 40th Regt. Ala. Adams, 2nd Floor Ferdon Bldg. Crestview, Fla. Dear Sir: I am in receipt of your letter of the 15th, enclosing application for pension of Mr. John Irvin, which has been filed in the Pension Department for consideration of the Board at its next meeting. I note that the record states "The rolls on file for Co. I, 40th Ala. Regt. Inf. C. S. A., (Col. Coleman Reg't) cover the period, July 1 to Dec. 31, 1862, the name John Irvin has not been found thereon. A Surgeon Certificate for discharge on file, dated Aug. 8, 1862, signed by Surgeon of the 40th Reg't. Ala. Inf. Recommends his discharge for Physical disability, and is shown to have been approved, but date of discharge is not shown. Therefore, I would suggest that affidavits of comrades be furnished to strengthen his claim if possible, as the record is so incomplete as to dates. Affidavits of two parties should also be furnished if the disability continued to the close of the war, as this information is very necessary. Whereas, John Irvin has been a citizen of State of Florida since March 1st, 1901 and Whereas the said John Irvin enlisted in Gantt's Company the 4th Alabama Regiments Confederate States of America, April 2nd, 1862 at Andalusia, Alabama and was transferred from said Company May 10th 1862 to Colonel Coleman's Regiment, where he honorably served in said C. S. A. until he was Honorably Discharged at Mobile, in state of Alabama on November 8th, 1863 on account of Physical Disability from exposure and disease contracted in actual line of service and duty in the C. S. A. and Where as the said John Irvin is now Blind in both eyes, and 83 years of age and is entitled to a pension but it has been made to appear by absence of official record of Col. Coleman's Regiment, that is Company I 40th Regiment Alabama Inf. C. S. A. showing the date of discharge of the said John Irvin that this fact debars the said John Irvin from receiving a pension under the General Pension Law, although he volunteered in a Regular Confederate States Organization and served there faithfully until Honorably Discharged --, therefore Be it Enacted by the Legislature of the State of Florida: Section 1. That the State Pension Board be and they are hereby directed to place the name of John Irvin of Okaloosa County Florida, upon the Pension Roll of this State to be paid in the same manner and at the same rate that other pensioners of the state are paid. Section 2. This Act shall take effect upon becoming a law.
