D. One Thousand Nine Hundred and twenty six, personally appeared before me a Notary Public in and for the County and State aforesaid Mrs. Ella Black a resident of Ft. Pierce, County of St. Lucie, State of Florida, who being duly sworn according to law, makes the following declaration in order to obtain a pension under the provisions of the General Pension Laws of Florida. That she is the lawful widow of Franklin H. Black who enlisted under the name of Franklin H. Black, in Pickens County, Alabama, on the 11th day of June, 1861, in Company H 11th Regiment of the State of Alabama and who was honorably discharged at Mobile, Alabama on May 20, 1865, on account of paroled on termination of Civil War. That he also served from time of enlistment throughout the said war. That she was lawfully married to the said Franklin H. Black under the name of Ella Gage in the County of Brevard State of Florida on the 28th day of January, 1891, and that she was not divorced from him before nor has she remarried since his death, which occurred on the 10th day of March, 1906, in the County of Hillsborough, State of Florida, except as herein- after stated. That she is a resident of St. Lucie County, Florida, and has continuously resided in the State of Florida since the 19th day of January, 1861. That she is not a pensioner of any other State. That her Postoffice address is Box 344, Ft. Pierce, County of St. Lucie, State of Florida. Ella Black (Signature of Claimant) Attests: (1) T. B. Ellis, Jr. (2) Cader G. D. 1926, I hereby certify that the above declaration, etc., was made known and fully explained to the applicant before swearing, and that I have no interest, direct or indirect, in the prosecution of this claim. Black and Ella Gage on the 26th day of January, A. D. 1891. The records further show that the above named parties were married on the 28th day of January, A. D. 1891, and that the ceremony was performed by A. C. Dittmar, N. P. Norman L. Black, known also as Frank H. Black, and also known Franklin H. Black, and Ella Gage which occurred at Ft. Pierce, Fla. on the 28th day of January, A. Black and was the family physician for said Black; that this affiant was one of the attending physicians at the death of the said Franklin H. Black; that said Black's death occurred March 10th, A. D. 1906, at Tampa in Hillsborough County, Florida. This affiant further says that said Franklin H. Black was the husband of Ella Black who subsequently removed to Fort Pierce, Florida. L. S. No. 2, Richmond, Va., July 24, 1862, for 30 days, a Private. Transfd. to Jeff Davis Legion Miss. Cav., C.S.A., Feb. 28, 1863, a Cpl. He became a member of Co. B, Jeff Davis Legion Miss. Cav., as Private. Muster roll Sept. & Oct. 1864, (latest on file) shows him present, a Private. He was surrendered May 4, 1865, and paroled at Mobile, Ala., May 20, 1865, a Pvt. Residence: Richmond, Miss. Also Borne as Franklin H. Black. Pierce, Florida July 14, 1926 Hon. Ernest Amos, Comptroller Tallahassee, Florida Dear Sir: -- Re: Application for Pension of Mrs. Ella Black, P. O. Address, Box 344, Ft. Pierce, Fla. I thank you for your letter of the 12th inst, inclosing form for application for pension by Mrs. Black; and stating that you do not find that her husband, Franklin H. Black applied for a pension, nor that she did so; and that you will write for a transcript of his service if I will advise the company and regiment in which he served and the state in which he enlisted. I have talked with Mrs. Black, and learn definitely that her husband never applied for a pension; and that she has never filed application for one heretofore. Her husband was opposed to the payment of pensions, and she herself has held to his views until she has become nearly blind; and she is now willing to make application. Her husband enlisted under the name of Franklin H. Black, or Frank H. Black, as he was also known, in Pickens County, Alabama, in June of 1861, and served in Company H of the 11th Alabama Regiment; throughout the war, and in May, 1865, under General Taylor; was surrendered, and paroled, at the termination of the war. She would indeed appreciate your writing for transcript of his record, as you have kindly offered to do; and in meantime, I will prepare for her the proper forms, and complete in time to have ready when you get transcript. Will you send me the transcript, or a duplicate of it, to attach to her application to be presented to the County Commissioners, or, should her application refer to it, and you retain it? In looking over Mrs. Ella Black's pension I find that only one affidavit of the death of her husband has been furnished and the law requires two, therefore, I will suggest that another affidavit be furnished certifying to his death as soon as practicable so that her claim will be in good shape.
