I, Jacob G. Mauney being of sound mine and memory and in consideration of the uncertainty of life, and other good reasons I do thence fore make this my last will and testament to wit. After all my just debts have been paid, I give and devise to my wife Margaret Mauney during her natural life, eighty acres of land on the north end of lot. I am now residing to include residence and other out Buildings, I also bequeath to her all articles brought by her and made by her since our marriage. One horse one small wagon and harness, one cow & calf, six head of hogs and such farming utensils as may be on the place at my death, necessary for it's cultivation, also one year's provisions for the family remaining with her. The remaining portion of all my property, both personal and Real Estate, and to include all property that may hereafter come to me. Shall be sold in the usual manner and divided equally between my children, namely W.H. Mauney, Sarah C. Mosteller, Mary E. Dawson, J.P. Mauney, Elizabeth P. and Louisa Mauney, Susan Watts, and Nancy Minerva Mauney except Nancy Minerva who shall have one hundred and fifty dollars over and above her equal portion. And that each of my children remaining at my house shall have such articles as belong to them individually such as clothing, bedding & furniture. I also hereby appoint my son W.H. Mauney executor to carry out this my will. In witness whereof, I have hereunto set my hand and affixed my seal this Fifteenth day of May in the year One Thousand Eight Hundred and Seventy One. J. D. Gray " Recorded 15 May 1871 ________________________________________________________________________ Georgia } Before me came on this 8th day of Aug 1871 Bartow County} at chambers for the purpose of proving the Last will and testament of Jacob G. Mauney deceased of one of the witness to said will. To wit John W. Gray and the will having been before the time brought before me for probate by the executor W. H. Mauney who has filed petition for probate of the same, he the said witness depose of the same that he said Jacob G. Mauney sign and publish the same as his last will on the day & year then stated & executed by him. That he witnessed the same at his request in his presence and in the presence of James M. Veach, J. D. Bowdoin the other witness who also witnessed said Will in presence of & at request of Testator and in presence of each other & of defendant (?) and that the same was voluntarily executed by him who was of sound & disposing mind and memory. Sworn to & subscribed before J. W. Gray 8th day of Aug 1871 J. A. Howard, Ordy. I do solemnly swear that this writing contains the true last will of the within named Jacob G. Bartow County } To all whom these presents shall come greeting Know ye that on the 4th day of August 1871, the last will and testament of Jacob G Mauney, deceased, late of said county, was exhibited in open court, and in common form of law proved and admitted to record a copy of which is hereunto annexed [?] and administration of all singular the goods and chattels and credits of said deceased was granted to W. H. Mauney the executor in and by said Will named and appointed, he having first taken the oath and performed all other requisites required by law. He is by order of said court and by virtue of these presents, legally authorized to administer the goods, chattels & credits of said deceased, according to the letter and effect of the said Will and Testament and according to law, and he is hereby required to render a true and perfect inventory of all and singular the goods, chattels, and credit, of the said deceased, and appraised and returned to this court according to law, and to render a true and correct account to the said Court of his acting and doings yearly and every year until his administration is fully completed.
