Bibb County } Gilbert administrators of all and singular the goods & chattels, rights and credits __________ of Randolph M. Gilbert, late of Bibb county deceased, who departed his life intestate, Greetings; Whereas the Hon. the Ordinary of Bibb Co. and State aforesaid, when sitting as a court of Ordinary at the January Term of said Court, holden on the 1st Monday in January 1860, did by his order, authorize, empower and license the undersigned administrators of the said Randolph Gilbert deceased, to sell, and to make & execute good & perfect deed or deeds to convey the real estate of said intestate for the benefit of the heirs at law and creditors of said estate, and whereas, having previously given notice required by the Statutes, in such cases made and provided, of intention to apply to said court for leave to sell said real estate, by publishing the same notice for the space of Two months immediately preceding the term of said court, at which term of said above mentioned order was ___________ in public newspaper printed at Macon, in the county of Bibb, called the Georgia Telegraph and having in pursuance of such performance of said order given the notice required by the Statute, in such case made and provided, of the time and place of said sale, by publishing the last mentioned notice for the space of forty days, immediately preceding said sale, in a public newspaper printed at Macon, in the County of Bibb, called the Georgia Telegraph, and also at the court house door of said county of Bibb and having on the 1st Tuesday in January of the year 1860 before the court house door of the said county of Bibb in the Town of Macon, the last mentioned place, being the usual place of holding public sales in & for the said County of Bibb & between the usual hours of sale to wit: between the hours of 6 in the morning and four in the evening, exposed the real estate hereinafter named to sale at public outcry, Thomas Jones being the highest and best bidder at said sale, the real estate was knocked off to him at the price ________ , of Seven hundred & fifty dollars. Know ye, that pursuant to the license, authority deed proven granted by virtue of the premises aforesaid & not otherwise, & in consideration of the sum of Seven hundred fifty- dollars, lawful money; theirs in hand paid, by the said Thomas Jones, who was the highest and best bidder for said real estate, at said sale, at & before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged, is hereby grant, bargain, sell, alien, & convey unto the said Thomas Jones, heirs & assigns forever, the following described lot or parcel of land to wit; being & lying in the Third district of originally Houston now Bibb Co. Known & distinguished in the plan of said district by the lot No (109) being one hundred and fifty acres, in the north east portion of said lot, of land adjoining the lands of Tilman Sanders Phillip Lamar & others. To have and to hold the said lot on parcel of land with the privileges and appurtenances hereof, of him the said Thomas Jones, his heirs and assigns to the only proper use, benefit and behoof forever in fee simple; & we the said L. & R. R. Gilbert administrators as aforesaid does covenant with said Thomas Jones his heirs and assigns, the said R. M. Gilbert deceased, seized and possessed of said above granted premises, and that we are duly authorized and empowered to convey the parcel, to the said Thomas Jones as aforesaid; and that we have in all things observed the rules and directions of the law in said sales, and that we will and our heirs, executors and administrators shall warrant and defend the said tract of land to the said Thomas Jones, his heirs and assigns, against all persons, claiming the same, by from or under the said deceased, in the said administration as aforesaid, but against no other person or persons whatever.
