Bibb County Georgia Deed Ambrose Barber to Robert Collins & John Martin File contributed for use in USGenWeb Archives by DaisyZ@aol.com Jeanie Smith Zadach Table of Contents page: http://www.usgwarchives.net/ga/bibb.htm Georgia Table of Contents: http://www.usgwarchives.net/ga/gafiles.htm State of Georgia Bibb County This Indenture made this ninth day of May 1837 between Ambrose Barber of the County and State aforesaid of the one part & Robert Collins & John Martin of the Same place of the other part; Witnesseth, whereas the said Robert Collins and John Martin have endorsed for the said Ambrose Barber a certain promissory note for the Sum of Twelve thousand dollars bearing date the Seventh day of May Inst, and payable Ninety days after date thereof which is intended to be discounted at the Branch of the Bank of the State of Georgia at Macon, and which said not is contemplated to renew from time to time. And the said Ambrose Barber being desired to Secure and Save harmless the said Robert Collins and John Martin against all responsibility as endorsers of the note aforesaid, and for all renewals thereof, therefore this Indenture Witnesseth that the said Ambrose Barber as will for and in consideration of Securing the said endorsers from the payment of the note aforesaid and all renewals thereof as the Sum of Five dollars to him in hand paid by the said Robert Collins and John Martin, at and before the Sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, Sold, released and confirmed unto the said Robert Collins and John Martin their heirs and assigns the following Tract Lots or parcels of Land, to wit, all that tract or parcel of Land Situate, lying and being in the City of Macon, and Known as Lots number Three and Four ( 3 & 4) in Square Number Two (2) containing one acre more or less, with all the appurtenances & improvements thereon: Also Lot number sixty Eight (68) containing two Hundred two & a half acres, also fifty acres in the East Corner of Lot numbers Eight nine (89), Situate, lying and being in the Sixth district of Originally Baldwin now Twiggs County. Also Lot number Ninety (90) containing Two Hundred two and half acres, and also one Hundred and Fifty acres a part of Lot number (91) to be laid out in Such a manner as to leave fifty two and a half acres in the South corner of said Lot so as to include the Mill pond on said Lot, with the balance of Rebecca Davis’ dowry Situate in the Sixth district of Originally Baldwin now Bibb County on Stove Creek. Also two other Lots number Sixty Seven (67) and Sixty Six (66) originally Baldwin now Twiggs County each containing Two Hundred two and a half acres. Also one hundred one and a quarter acres lying on the Waters of Stone Creek, being the Northern half of Lot number Twenty five (25) in the Twenty Eighth district of Originally Wilkerson non Twiggs County. And also Lot number Twenty four (24) in the same district and County except fifty acres in the South Corner of said Lot, which now belongs to William Honeycut. Also Lot number Eighty eight (88) in the Seventh District of Originally Baldwin now Twiggs County containing Two hundred two and a half acres: Also all that other tract or parcel of Land containing One Hundred and Fifty five acres more or less being so much of that tract, or parcel of Land known as Lot Eighty Nine (89) in the Southern District of Originally Baldwin, now Twiggs County adjoining the Land of Elisha Davis and others Situate and lying on the Waters of Stone Creek, making in the whole Mortgaged premises Sixteen hundred and twenty two and one quarter acres of Land, being the Citys Lots and the Several other Tracts and parcels herebefore specified. To have and to hold the said bargained premises, with all and singular the rights members, improvements and appurtenances thereunto belonging unto the said Robert Collins and John Martin their heirs and assigns, and to their only proper use, benefit and behoof forever. And the said Ambrose Barber for himself his heirs and assigns, the said bargained and Mortgaged premises unto the said Robert Collins and John Martin their heirs and assigns, will forever warrant and defend against the claim of all persons whatsoever. Provided nevertheless always, that if the said Ambrose Barber his heirs or assigns shall and do will and truly pay or cause to be paid unto the holders thereof, the aforesaid promissory note or any note given in renewal thereof on the day and time therein mentioned for payment, and save & keep harmless & indemnify the said Robert Collins and John Martin their heirs & assigns from eh payment of said note or any note given in renewal thereof, then and from thenceforth as well this present Indenture and the Estate hereby granted, as the said receipt promissory note, shall cease, determine and become absolutely null and void to all intents & purposes.
