All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Golowka http://www.genrecords.net/emailregistry/vols/00012.html#0002972 March 14, 2015, 2:17 am Source: Bibb County, Georgia Will Book B, Pages 207-208 Written: May 10, 1859 Recorded: May 6, 1862 Georgia, Bibb County I Asa E Ernest of said county being of advanced age but of sound and disposing mind and memory make declare and publish this as my last will and testament hereby disposing of all the property I may own or possess at the time of my death & hereby revoking all former will or wills before made by me. 1st I desire my body to have the rite of Christian burial _ited to my condition in life. 2nd I desire all my debts, if any, paid as soon after my death as the same can be done 3rd To my wife, Juliann Earnest I give the sum of six thousand dollars ($6000) in such of my property as she may select at a fair valuation or in money at her option if the money should be on hand; the above to her for & during her live & at her death to be equally divided among my six children, share and share alike, in case of the death of any of my children their descendants to take his or her share; the above to my wife in full & in lieu of all claims of dower. 4th I have advanced my children Martha Sherwood and William C each two hundred & fifty dollars Mary E and Amelia each one hundred and seventy dollars and I desire eight dollars shall be paid to said Mary E & Amelia each, and two hundred fifty dollars to Asa M. & George W each to make all six equal in this respect. 5th All the balance of my estate & property of every kind & sort I wish equally divided and given to my said six children, share and share alike; in case any of my said children should die leaving child or children, such child or children will take the share & part of the deceased parent equally among them; If they or any of them died leaving no child or children, then their part & share to be divided among my other surviving children. 6th I desire that all and everything any of my daughters shall receive under this my will shall be there for their lives as a sole & separate property free from the debts or contracts of any husband. Any of them may have and at their deaths to be equally divided among their children but if they leave no children or descendants, then to go to my other children’s descendants if any. I hereby nominate and appoint my three sons William C, Asa M & George W (as soon as George W Is of age) Executors of this my last will and testament and trusting for my three daughters & their property; and I hereby authorize them to sell and dispose of the property in their discretion at public or private sale; and I do not wish them to go to the trouble or expense of making any returns to the Court of Ordinary, but wish them to settle and divide the estate under this will among themselves. In witness whereof, I have hereunto set my hand and affixed my seal to this as my last will and testament this 10th day of May AD 1859.
