Bulloch Co Ga
Written: November 30, 1878

State of Georgia, Bulloch County

This indenture made this 30th day of November in the year of our Lord Eighteen 
Hundred and Seventy Eight between Owen Joiner of the county and State 
aforesaid of the one part and Heard & Co of the same place of the other part, 
Wil__peth that the Said Owen Joiner hath this day made and delivered to said 
Heard & Co his certain promissory note subscribed with his hand and bearing 
even date with these presents, whereby the said Owen Joiner hath promised to 
pay said Heard for or bearer fortyfive 50/100 dollars on or before the first 
day of September next ensuing the date thereof, for value received. Now for 
and in consideration of the some of five Dollars by the said Heard & Co, to 
the said Owen Joiner in hand paid at and before the sealing and delivery of 
these presents,the receipt whereof is hereby acknowledged, as well as for the 
better securing the payments of the aforesaid promissory note, the said Owen 
Joiner hath granted bargained and Sold, and doth by these presents grant 
bargain sell and convey unto the said Heard & Co for their heirs and assigns 
all that tract or parcel of land situate lying and being in the county 
aforesaid bounded on the South and Southwest by Martha Dutton & Saml Williams, 
and on the East by lands of Matthew Williams and on the North by lands Known 
as the "Rowland land" containing Sixty  acres more of les with all the rights 
members and appurtinances to said lot a tract of land in anywise appertaining 
or belonging. To have and to hold the said bargained premises to the said 
Heard & Co for their heirs and assigns to them and their own purpis use 
benefit and behoof for ever. 
And the said Owen Joiner for himself, his heirs Executors and Administration, 
tho said bargained premises unto the said Heard & Co will warrant and forever 
defend against the claim of himself and heirs and against th claim of all 
other persons whomsoever. 
Provided Nevertheless That if the said Owen Joiner him his Executors and 
administrators shall well and truly pay, or cause to be paid, unto the said 
Heard five & 50/100 Dollars, on the day and time mentioned and appointed with 
ten percent Interest on the same according to the terms of said note, then and 
from thenceforth, as well this present L_______use and the right to the 
property thereby conveyed as said Promissery Note, shall cease, determine and 
be void to all intents and purposes. 
In wit____whereof, the said Owen Joiner hath hereunto set his hand and affixed 
his seal the day and year first above written.
