All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Howard Griffin hgriffin1@triad.rr.com and Howard Griffin hgriffin1@triad.rr.com January 30, 2007, 1:56 pm 60th and 62nd Written: June 23, 1906 Recorded: June 28, 1906 STATE OF GEORGIA ) COUNTY OF BURKE)¬ THIS INDFNTURE, made this the twenty third (23rd.) day of June in the year of our one thousand nine hundred and six (1906) between Adam McCullough of the County of Burke and of Georgia of the first part and Mahala Baker of Charleston, South - Carolina, De1ilah Rance of Florence, South Carolina, Henrietta Lane, Jonas McCullough, Tracy McCullough, Lula McCullough, Virginia Moore and Willie McCullough of the County of Burke and State of Georgia of the second part,—— WITNESSETH, That the said party of the first part for and in consideration of the love and affection that he hath for the above named chi1dren and grand- children and for the further consideration of the sum of ten dollars paid by each at and before the sealing and delivery of these presents receipt whereof is hereby acknow1edged, hath granted, bargained, sold, conveyed and confirmed and by these presents doth sell, bargain, convey and confirm unto said parties of the second part heir heirs and assigns the tact of land hereinafter described equally, that is share. and share alike between each one of said parties of the second part per capita and not per stirpes, said tract of land being described as follows: “All that tract or parcel of land lying, situate and being in the sixty and sixty second (60th & 62nd.) districts Georgia Militia of Burke County, Georgia, containing eight hundred and eighty eight (888) acres, more or less and bounded on the North by lands of Van Rogers, and Mrs. Mary Lane; East by Dr. H. B McMaster and E. A. Smith; South by lands of W. H. Davis and West by Serena Brooks and W. H. Davis. The land hereby conveyed being the tract whereon I now reside and known as the “McCu1lough Tract”, and this conveyance is made subject to the limitations, terms and conditions hereinafter set out Together with all and singular the rights, easements, ways, members and appurtenances to said tract of land, being, belonging or in anywise appertaining and the remainders, reversions, rents, issues and profits thereof and every part thereof, except as hereinafter stated. TO HAVE AND TO HOLD, the said tract of land and all and singular, the premises and appurtenances thereto belonging as aforesaid, and every part thereof unto the said parties or the second part their heirs and assigns forever. It being expressly stipulated, covenanted and agreed between the parties to this deed, that the said Adam McCullough reserves the right to have, use, occupy and enjoy the premises therein conveyed as well as the rents, issue and profits thereof, for and during the term of his life. The purpose and intention of This instrument being, to convey apresent estate eo instanti but to postpone the possession of said described property until after the death of the grantor or the said Adam McCullough. I And the said party of the first part and his heirs, executors, administrators and assigns the said tract of land and the premises aforesaid and every part thereof and unto the said parties of the second part there heirs, executors, administrators and assigns against him the party of the first part and his heirs, executors and assigns, and all will warrant and forever defend by these presents.
