Between James E. Bankston of the county of Butts of the one part and James H. Stark of the county of Butts of the other part. Witnesseth that the said James E. Bankston for and in consideration of the sum of three hundred and forty eight dollars in hand paid of and before the sealing and delivering of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold ______ convey and confirm unto the said James H. Stark his heirs and assigns all that tract of land on which I reside containing two hundred and ninety four acres more or less being part of Lot one hundred and twelve and eighty one in the first district of originally Henry now Butts county, and those parts of said lots which I am on are the following conditions to wit that if I punctually pay to same James H. Start his heirs or assigns certain notes amounting in all to three hundred and forty eight dollars made by me this day payable to said James H. Stark or bearers due the twenty fifth of December just then this deed of mortgage to be null and void else to remain in full force and virtue. Said not bearing interest from date not to be charged if principle sum is punctually paid. To have and to hold said tract or parcel of land under the above conditions as mortgage with all singular the rights member and appurtenances thereof whatsoever to the said tract of land being so belonging as in any wise appertaining with the remainder and remainders reversion and reversions rents ______and profits thereof to only proper use benefit and behoof of him the said James H. Stark his heirs, executors, administrators and assigns in fee simple and the said James E. Bankston his heirs, executors and administrators the said bargained promises unto the said James H. Stark, his heirs, his executors, administrators and assigns against the said James E. Bankston his heirs, executors and administrators and all and every person or persons shall will warrant and forever defend by virtue of these presents. In witness whereof the said James E.
