Governor Atkinson has decided in the case of Tom Delk that patience is no longer
a virtue, and having again respited the young outlaw he names May 7th and say
thus far and no farther.

Governor Atkinson will take a stand in the case of Tom Delk, who has been under
sentence of death for the murder of Sheriff Gwyn, tht will probably hasten the
trial of his father, Taylor Delk, also convicted of murder, or remove Tom Delk
from the reach of the courts as a witness in the old man’s behalf.   The
governor has respited Tom Delk again until May 7, this being the third time he
has stayed the sentence of execution in order that Tom might be used as a
witness when his father is tried the second time.   Old man Delk has always
claimed that he was not in the house from which the shooting was done when
Sheriff Gwyn was killed and Tom Delk’s testimony is to be used to established
that fact, as he was in the house.

The governor’s view is that the delay in Taylor Delk’s trial ought not be
allowed to indefinitely prolong the execution of Tom Delk.  Col. W. C. Glenn,
attorney for Taylor Delk, has been sick for a month unable to attend court at
all.  If it appears that he is not likely to be able to try Taylor Delk between
now and may 7th, Governor Atkinson’s purpose is to require that the old man
secure some other counsel to represent him so that the trial can be held, or
that Tom Delk’s testimony be dispensed with whenever the trial shall take place,
as he thinks there has already been too much delay in the case.
