Just at dark he walked unexpected into a trap cleverly set for him by Detective Looney of the Atlanta city force, and so snugly was he entrapped that he did not have time to use his 38 calibre Winchester, with which he had declared he would kill anyone who attempted to arrest him. He is now in the Atlanta jail. Jackson Argus – Week of May 14, 1896 ……………………………………………………………………………………………… SPEEDY TRIAL Tom Delk, the notorious outlaw and highwayman, who was charged with the murder of Sheriff Gwyn of Pike county a few weeks ago has been tried, found guilty of murder and condemned to be hanged on June 19th. This the manner in which to dispose of such cases. Judge Beck is to be congratulated on bringing to trial these men so soon after their arrest. By so doing he has well nigh prohibited lynch-law in the future in Pike county. For the good people now know that if any outrage is committed in their county the lawless one will be brought at once to the courts and given a fair trial. If in all such cases as that of the Delks could be disposed of immediately lynch law would soon be a practice of the past. If the people knew in every violent case that the criminals would be brought to a speedy trial they would never be guilty of such actions as characterizes lawless mobs. Justice is often delayed and many times is never meted to the guilty ones and the people knowing this sometimes take the law into their own hands, but if our judges will follow the example set for them by Judge Beck in calling a special term of court to try extraordinary cases in a few months, there would be no such actions on the part of our people as investing themselves with the authority of the court. Jackson Argus – Week of May 21, 1896 …………………………………………………………………………………… NEW TRIAL NOT GRANTED The motion for a new trial in the Tom Delk murder case was heard Tuesday by Judge Beck. The plea was insufficient and the attorneys for the murderers failed to show cause why a new trial should be granted, hence the judge refused to grant it. In the case of Taylor Delk the hearing for a new trial was postponed ‘till today when Judge Beck will hear the motion. The stenographer’s notes not being accessible this step was necessary. Jackson Argus – Week of June 6, 1896 ……………………………………………………………………………………….. TOM DELK TO HANG The trial of Tom Delk at Zebulon was of short duration, occupying hardly the space of one day. The jury found him guilty of murder after remaining out less than hour. The people of Pike are satisfied with the verdict.
