The court found no error in the judgment of the lower court in the case of Tom Delk, but it granted a new trial to old man Taylor Delk upon the ground that the lower court errored in not allowing time for one of Delks four attorneys to reach the scene of the trial. This was the only error recognized by the Supreme Court in the long bill of exceptions presented to them by the Delks attorney. It is probably that Tom Delk will not hang immediately as he will no doubt be used as a witness in the new trial of his father. After this he will be resentenced to hang. It is quite likely also that Taylor Delks attorney will endeavor to get a a change of venue. Thus the slow grines of the courts often cheat the gallows of its victims and give occasions for lynching bees. Jackson Argus – Week of October 22, 1896 ………………………………………………………………………………………….. It was our misfortune to see the notorious Tom Delk last Monday while he was being carried back to Zebulon to be re-sentenced by Judge Beck. He is quite youthful in appearance and has not the air of mien of a criminal. There can be no doubt of his guilt and the gallows claim him.
