Matilda Dearing Deposition-"Kitchens vs Kitchens", Georgia Supreme Court file-

Matilda Dearing was deposed regarding the will of her father, Charles Kitchens 
of Jasper County. Charles Kitchens died there on January 13, 1864. His estate 
was originally processed as "intestate", though his widow Elizabeth said that 
he left a will, which was lost(or stolen). For unknown reasons Elizabeth was 
denied letters of administration; Jeese M. Owens was named administrator, an 
inventory was taken and distributions were made. Sometime thereafter, widow 
Elizabeth presented a copy of the will for probate(September Term-1865). It was 
immediately contested by son Joel(and others)but was proven in Jasper County 
Superior Court-October Term-1867. After local appeals failed it was taken to 
the Georgia Supreme Court, where the lower court decision was affirmed-June 
Term, 1869.

Matilda Dearing, daughter of Charles and Elizabeth Kitchens, was born in Jasper 
Co. March 2, 1826. She married Thomas J. Dearing on December 28, 1843. There 
were three known children: Arra Ann, Sarah Adaline, and William Henry. "Annie" 
married John L. Fincher in Jasper Co. February 27, 1862. On August 26, 1863, 
Thomas J. Dearing purchased improved land in Butts Co. He paid $3000 for #217/ 
8D.(the "plantation" of Dr. James H. Bryans near Fincherville). Within a few 
months he was killed in the Civil War(a Thomas J. Dearing had joined Zachery's 
Rangers in Henry Co. in 1861). Daughter Arra A. Fincher died March 20, 1864, 
shortly after the birth of a son who also died. Sister, Sarah Adaline Dearing, 
married John L. Fincher in Butts Co. on May 15, 1864.

Matilda Dearing died October 30, 1869. She is buried in the Fincher cemetery 
with daughters, Sarah and Arra(& her unnamed infant son)-and "double" son-in-
