Kitchens-"Kitchens vs Kitchens"- Georgia Supreme Court file-State Archives[Page 5 of 6] See additional comments below text. First cousins, Sarah Fincher and Henry Z. Kitchens, were deposed regarding the will of their grandfather, Charles Kitchens of Jasper Co. Charles Kitchens died there on January 13, 1864. His estate was originally processed as "intestate", though his widow Elizabeth said that he left a will, which was lost(or stolen). For unknown reasons Elizabeth was denied letters of administration; Jeese M. Owens was named administrator, an inventory was taken and distributions were made. Sometime thereafter, widow Elizabeth presented a copy of the will for probate(September Term-1865). It was immediately contested by son Joel(and others)but was proven in Jasper County Superior Court-October Term-1867. After local appeals failed it was taken to the Georgia Supreme Court, where the lower court decision was affirmed-June Term, 1869. These depositions were among many taken for the final appeal in Jasper County Superior Court. Sarah Fincher was the daughter of Thomas J. and Mitilda(Kitchens)Dearing. Her family moved from Jasper Co. to Butts Co. in the early 1860s. In August 1863, her father purchased the "plantation" of Dr. James H. Bryans near Fincherville. Sarah's sister, Arra Ann Dearing, had married John L. Fincher in Jasper Co. in February 1862. After Arra's death, Sarah married John Fincher in Butts Co. in May 1864!(Sarah's father had died in the Civil War in late 1863) Henry Z. Kitchens was the son of Joel Kitchens of Jasper Co. Joel and brother Moses Kitchens had contested the Charles Kitchens will in Jasper Co. The legal fight seemed to pit widow Elizabeth Kitchens & daughter Bethina Wilson against the other Kitchens siblings. Henry Z. Kitchens was accused of "playing ghost" near his grandmother's(Elizabeth Kitchen's)house, perhaps to influence her into not offering the will for probate.
