Copy of Last Will and Testament of T. J. Preston

State of Georgia, Butts County. 

Item 1st. I, Thomas J. PRESTON of said County and State, intending this to be 
my last will and testament, I hereby revoke all wills heretofore made by me. 

Item 2nd. I wish my executor, herein named as soon as possible after my death 
to pay my debts. I wish him to select such property from my estate which can be 
best used for that purpose, and I empower him to sell the same publicly or 
privately, as he may think best, without any order of any Court. 

Item 3rd. I will that my plantation, and all the stock thereon, and farming 
utensils, my executor keep together for the use of my beloved wife, Elizabeth 
PRESTON, during her lifetime, with full power to sell or exchange any of the 
personal property and reinvest, applying the net proceeds yearly, or so much 
thereof, as may be necessary to the support and proper maintenance and care of 
my said wife, Elizabeth Preston, and at her death, all the property then 
remaining of any kind, personal and real estate, shall be sold by my executor 
without an order of any Court, and the proceeds thereof with all or any other 
funds or money belonging to my estate, after first paying all legal expenses, 
be equally divided between my children, then in life, share and share alike, 
and the heirs of such as may be deceased. My daughter Clarrisa SMITH, former 
wife of W. F. SMITH and Francis MADDOX, former wife of M. M. MADDOX now 
deceased, the distributive share of each of my deceased daughters were they in 
life, is to be equally divided between the heirs of each. The sale of all 
property by my executor be privately or publicly. 

Item 4th. I do hereby appoint W. M. PRESTON Executor to this my will. He shall 
not, as required by law, make Annual returns to the Court of Ordinary but shall 
make returns at such times as he thinks proper. 

In testimony whereof, I hereto set my hand, this 10th day of August, 1904.

our presence as witnesses thereto by his request, this 10 day of August, 1904, 
we signing as witnesses in his presence.

GEORGIA, Butts County 

By the Honorable the Ordinary of said County. 

To all to whom these Presents shall come or be made known, Greeting: 

Know Ye, That on the 6 day of February, in the year of our Lord Nineteen 
Hundred and eleven, the last Will and Testament of T. J. PRESTON, of said 
County, deceased, was exhibited in open Court, and in common form of law proved 
and admitted to record, a copy of which is hereunto annexed; and administration 
of all and singular the goods, chattels, credits, lands, and tenements of said 
deceased, was granted to W. M. PRESTON, the Executor in and by said Will named 
and appointed, he having first taken the oath and performed all other 
requisites required by law, and he is, by order of said Court, and by virtue of 
these presents, legally authorized to administer the goods, chattels, credits, 
lands, and tenements of said deceased, according to the tenor and effect of 
said Will and Testament, and according to law, and he is hereby released of 
making perfect inventory of all and singular the goods, chattels, credits, 
lands and tenements of the said deceased, by will of said T. J. PRESTON and 
only required to make returns when he thinks best and proper. 

In Witness Whereof, I have hereunto set my hand and affixed the seal of my 
office, this 6 day of February, 1911.
