His father Mr. Thomas Upshur, it was understood, was to overtake them at the mill. When the little boy and his uncle got to the mill, his uncle went off to a syrup mill which he had in operation near by. In the meantime, the litttle boy took a notion he would go home with Mr. Clark Hindon, but got only far as Mr. Eady's, some two or three hundred yards, where he stopped, afterwards, returning to the mill. It was but a short time after his return that he wandered off up stairs where in some way or other he was caught in the machinery and crushed to death. His head was cut and his arms badly bruised. At the time he was in the mill, the miller was present and a Mr. Harris, but they being busy, failed to see him when he went up the stairs. The stoppage of the mill caused an investigation to see what was the matter and it was then discovered that the mutilated body of the little boy was the cause of the stoppage. Newman states that he acted entirely in self defense as his brother was at the time advancing on him with a loaded pistol, threatening to kill him. The difficulty took place at the home of J.C.
