Will of Leroy McWhorter:
State of Georgia
Carroll County
January 25, 1870


In the name of God Amen I Leroy McWhorter being of sound
and disposing mind and memory and considering the
uncertainty of this mortal life do make and declare this
my last Will and Testament -- in manner and form
following.

Item 1st Provided my Wife Mary McWhorter survive me I
hereby give, grant, bequeath & devise unto her all my
real and personal estate during her natural life for her
own personal benefit and to her sole use and after her
decease all the property both real and personal to be
sold and all Just debts and expenses that may have
accrued to be paid out of the proceeds of said sale, 

and my Daughter in law Mary Ann McWhorter to have the sum
of thirty seven dollars paid to her from sale of the same
property provided there is balance after complying with
the aforesaid 

then my four Grand children Leroy Johnston, Thomas
Johnston, Alfred Johnston and Martha McWhorter to have
the sum of One hundred and fifty dollars to be equally
divided among them provided there be that amount, but if
not whatever there is to be disposed of and applied to
the same purpose Provided there is Still a remainder then
it is to be divided equally among all my heirs. In
Witness whereof I have hereunto set my hand and affixed
my seal the day and Year above written.

I Leroy McWhorter do hereby by these presents appoint my
two Sons Moses A. McWhorter and Newton A. McWhorter to be
my executors of this my last Will and testament hereby
revoking all others witnessed as above written.
