Archives Written: March 6 1929 WILL OF OLIVER CLARK KINNEY TEMPLE, GA. State of Georgia, County of Carroll Last Will and Testament of O. C. Kinney I, O.C. Kinney of said state and county being of sound and disposing mind and memory do make this my last will and testament here by revoking all wills heretofore made by me. I wish my executor as soon as possible after my death to pay any debts if a sale of property shall be necessary I wish him to select for sale that which can be most advantageously used for that purpose and I authorize him to sell the same at public or private sale as he may see fit. At my death I direct that all my property both real and personal be sold and proceeds be divided giving my daughter, Mrs. Fannie Lou Ferguson, one hundred dollars and the remander be equally divided between all my boddily heirs and I authorize my executors to sell all my property at public or private sale as they may deem fit. I do hereby appoint T.W. Kinney and T. W. Ferguson executors of this my will and testamentary where of I have here to set my hand this 6 day of March 1929. O.C. Kinney APPLICATION TO PROBATE IN COMMON FORM State of Georgia, Carroll County To the Hon. E.T. Steed, ordinary of said county: The petition of T.W. Kinney, and T. W. Ferguson a resident of said county, and nominated executors of the last Will of O.C. Kinney also a resident of said County, who died on the 13th day of November 1930, owning valuable read and personal estate in said State disposed of by said Will, amounting to the sum One Thousand Dollars, and which remains to be administered, respectfully showeth that said O.C. Kinney died testate, that his Will is herewith presented for probate at the regular term of the Court of Ordinary of said County in common form; that your petitioner are named in said Will as its executors; Wherefore, your petitioner prays leave to prove said Will in common form; and the issuing to them of letters testamentary upon their taking the oath of office. November 20, 1930 T. W. Kinney T.W. Ferguson STATE OF GEORGIA, COUNTY OF CARROLL Before me came R.T. Sims named as a witness to the within writing, purporting to be O.C. Kinney’s last will, and being duly sworn, saith that he with J.T. West and F.L. Wynn __________O.C. Kinney ___ and in his presence and in presence of each other, did attest as witnesses the within writing as O.C. Kinney’s Will that the same was signed and published by O.C. Kinney in their presence as his last Will; that he was at the time of said attestation and signing by him of sound and disposing mind and memory; that he executed the within paper voluntarily. R.T. Sims Sworn to and subscribed before me, this 1st day of December, 1930. E.T. Steed, ordinary Carroll COURT OF THE ORDINARY, Dec. Term, 1930. The above Petition of T.W. Kinney and T. W. Ferguson nominated executors of the last alleged Will of O.C. Kinney duly filed, having been supported by proper proof of R.T. Sims a witness to said Will, that said O.C. Kinney died a resident of said County; that he and the other witnesses J.T. West and F.L Wynn saw him sign and heard him publish the alleged Will as his own last Will that he attested the same as a witness at his request and in his presence with ______and F.L Wynn so attesting also at his request; that said O.C. Kinney was at the time of said signing and attestation, of sound and disposing mind and memory, and did in the execution of said Will ___________________having been duly proved in common form, and that letters testamentary issue to them upon their taking oath of office. E.T. Steed Ordinary Additional Comments: This is the will of Oiver Clark Kinney of Temple, Ga. He was born June 16, 1844 and died November 13, 1930.
