I Joel Woods Senior of the State & County aforesaid being aged and infirm & believing that I must shortly depart this life, deem it right and proper both as respects myself and family to make a disposition of the property which a kind providence has blessed me & do therefore make and declare this to be my last Will and Testament hereby revoking all others heretofore made. Item 1st I Will and direct that my body be buried in a decent & Christian manner suitable to my circumstances & condition in life. Item 2d I Will and bequeath to my two sons Nathan Woods & Joel Woods Jr. my tract of land being the north half of lot No. (98) ninty eight in the sixth (6) District of Carroll County Georgia the same to be divided between them as follows, beginning on the south line of said tract of land at the point where the ditch strike said line, thence running north & northward along said ditch to its termination, thence due north to the north side of said line. My son Nathan Woods to have the Western division of said land & my son Joel Woods to have the Eastern, I also give unto my two sons above named my Blacksmith tools. Item 4th The third Item of this Will shall be subject to the following Conditions, my sons Nathan and Joel Woods Jr. shall not sell my land during the life of my wife Mary Woods, and my sons Nathan and Joel Woods shall be bound to give my wife Mary Woods a comfortable house and decent support during her life, or one fourth of all the proceeds of said land as they may agree or as my [word omitted] may elect. [probably should have said "wife"] Item 5th I will and bequeath to my daughter Rachel S. Michael my black heifer and calf. Item 6th I will and direct that after all my Just debts shall have been paid out of my personal Estate including all debts due me if anything shall remain, the same shall be equally divided among Polly Ann Yarbrough & Betsy Jane Woods & William Woods my grand children & my daughter Rachel S. Michael. Item 7th I hereby appoint William Williams of State & County aforesaid Executor of this my last Will & Testament. Michael Leroy Williams Carroll Court of Ordinary October Term 1860 The Will of Joel [the name Williams written and struck through, the name Wood written above] Senior being produced in open court for probate by the Executor named therein who has filed his Petition to prove the same and two of the witnesses, W.W. Awtry and John T. Broom being present in open Court in this the regular Term of the Court who after being duly sworn depose and say that they saw Joel Woods Senior sign, seal publish and declare the within as his last Will and Testament while of sound and disposing mind & memory, that they witnessed the same for him at his request & in his presence & of each other & that they saw W.R. Michael and Leroy Williams the other subscribing witnesses sign the same as Witnesses in their presence & in presence of the Testator and at his request and that the same was Executed voluntarily by him on the day it purports to have been done. Blalock O.C.C. --------------------------- End Notes: Joel Wood(s) Sr., thought to be the son of Rev. Richard Wood and Mary Price, was married to Mary Sellers, Jan. 28, 1809 in Jefferson County, Tennessee. Mary is thought to be the daughter of Samuel Sellers and Nellie (maybe Eleanor) Unknown. Joel and Mary were in Monroe County, Tennessee in 1830, 1840 and 1850, and in Carroll County in 1860. According to early censuses, Joel had 12 or 13 children, among them, Mary Ann Wood (who shows in the 1850 census) who married William Jasper Payne and moved to Carroll County sometime after their marriage in 1852. Mary lost William Jasper in the Civil War and remained in Carroll County until her death in 1897-1898. The reason Mary and the other children were left out of the will is unknown. Nathan Wood(s) married Nancy Jane Unknown. Both are buried at Powell's Chapel in Carroll Co. Joel Wood(s), Jr. married Rachel Unknown. Joel died during the Civil War and Rachel is thought to have married a James McWhorter in 1871. Joel and Rachel's daughter, Josephine is thought to have married a Moses C. McWhorter. Joel and Rachel's son, Josiah, married Frances Emmaline McWhorter, the daughter of Moses McWhorter and Sarah Kinney. Rachel Wood(s) married John Michael, thought to be the son of William Michael and Hannah Sellers. Rachel and John are found next door to Joel in Carroll Co. in 1860. William and Hannah Michael also moved from Monroe Co., TN to Carroll County.
