Stephenson Family Homestead Land Records 1911-1943 Chattooga Co, GA The information in these records was transcribed by William L. Stephenson, Jr. for inclusion in the GeorgiaGenWeb project, a portion of the USGenWeb project. The properties represent the "ole family farm" purchased by his great-grandfather and then his grandfather. The original documents are on file in the State of Georgia, Chattooga County courthouse in Summerville, Georgia. These documents were collected during a process of updating the family history. In transcription, every attempt has been made to illustrate the material in the original form including punctuation, capitalization, and spelling. Information in [brackets] has been added for clarity by the transcriber. Land Deeds and Legal Records ------------------- State of Georgia Chattooga County This Indenture, Made and entered into the 31st day of October, in the year of our Lord One Thousand Nine Hundred and Eleven, between W. B. Anderson of the one part, and O. F. Stephenson [Oscar Fitzland] of the other part, Witnesseth: That the party of the first part, for and in consideration of the sum of Thirteen Hundred and Fifty Dollars ($1350.00) in hand paid, the receipt whereof is hereby acknowledged, hath granted, sold and conveyed unto said O. F. Stephenson heirs and assigns, all that tract of land situate, lying, and being in the County of Chattooga as follows: One undivided half interest in the following described lands to wit: - All of lot of land number nine (9) in the 5th district and 4th section of Chattooga County, Georgia, containing one hundred and sixty acres, (160) acres more or less. Also thirty acres more or less, of lot number ten (10) in the fifth district and fourth section of Chattooga County Georgia, described as follows: - Said thirty acres (30) being cut off of the North side of said lot by a straight line running East and West across said lot, parallel to the North line and thirty rods from same. Also thirty acres off of lot number one hundred and thirty two (132) in the 14th district and fourth 4th section of Chattooga County, Georgia, described as follows: - beginning at the Northeast corner of said lot, thence South forty (40) rods to the Rosa Edwards corner, thence with the Edwards line one hundred and ten (110) rods to Sparks line, thence North with Spark’s line to North line of said Lot, thence East on original line to the Northeast corner. Also one hundred and fourteen acres more or less, of lot number one hundred and thirty one (131) in the 14th district and 4th section of Chattooga County, Georgia, being all of said lot except forty six (46) acres formerly owned by W. S. Sparks, but now owned by Thompson Hiles & Co., Also excepting two acres (2) more or less, on the North side of said lot, reserved for water privileges, and described as follows: - beginning at the center of the North line of said lot, and going South 52 degrees, West thirty four (34) rods across branch to center of road leasing from Summerville, Ga. to Holland Ga., thence Northwest with said road to the North line, thence with the North line to beginning point. All of said lands lying and being in one body, and containing three hundred and thirty four (334) acres, more or less, which said tract or parcel of land the said W. B. Anderson will well and truly warrant and defend form the claim of all persons whatsoever, unto the said O. F. Stephenson heirs and assigns, forever in fee simple. In testimony whereof the said W. B. E. Majors of the one part, and O. F. Stephenson [Oscar Fitzland] of the other part, WITNESSETH: - that the party of the first part, for and in consideratin of the sum of TWENTY TWO HUNDRED ($2,200.00) Dollars in hand paid, the receipt whereof is hereby acknowuledged, hath granted, sold, and conveyed unto the said O. F. Stephenson heirs and assigns, all that tract or parcel of land situated, lying, and being in the County of Chattooga as follows: Eighty (80) acres more or less, in lots of land numbers two hundred and fifty four (254) and two hundred and fifty five (255) in the 13th, district and 4th, section of said Couanty and State. Described as follows: - Beginning wherewest line oflot two hundred and fifty four (254) crosses Chattooga SouthernRailroad:; thence North with Ami and Alpine public road to menlo and Jamestown Public road: thence Northeast with said public road 145 rods to a certain oak tree; thence North, 74 de grees west 60 rods. To. Original line: thence North on said line 112 rods to a corner: thence South. 30 degrees East, 212 rods to Chattooga Southern Railroad: thence Southwest with said railroad to beginning point. Denton, Jr. of the County of Chattooga of the second part, Witnesseth: That the said party of the first part, for and inconsideration of the sum of Forty Two and sixty six ($42.66) Dollars, in hand paid at and befor the sealing and delive of these presents, the receipt whereof is hereby acknowuledged, has granted, bargained, sold, and conveyed, and by these presents does grant, bargin, sell and convey unto the said party of the second part his heirs and assigns, all that tract or parcel of land lying and being a Lot of land No, two hundred and sixty four (264) in the 13th, district and 4th, section of said state and County described as follows: Beginning at the South east corner of said Lot (264) and runing west on original east and west line Ninety one (91) rods thence North seven and half (7.1/2) rods: thence east Niney One (91) rods to east line of said lot (264): thence South with said line Seven and and one half (7.1/2) rods to begining point containing Four and one fourth (4.1/4) acres more or less, To have and to hold the said bargained premisses with all and singular the rights, members and appurtenances thereof, to the same being, belonging or in any wise appertaining, to the only proper use, benefit and behoof of W. F. Stephenson [Oscar Fitzland], late of said County, deceased and A. P. [Alonzo Park] Stephenson, Mrs. Janie [Janie L. Stephenson] Ash, Mrs Mittie B. [Mittie Bell Stephenson] Estes, Mrs. Jessie [Jessie Alice Stephenson] Brooks and Mrs. Laura [Laura Buelah Stephenson] Kling, all children of said O. F. Stephenson, deceased, and parties of the first part herein have given, granted, bargained and sold. And by these presents do hereby give, grant, bargain sell and convey and assign G. W. Stephenson, and recorded in book 10, page 309 of the deed of records in the office of the clerk of the Superior Court of said County; Second; All rights, interests, titles and equity of redemption which the said parties of the first part have in, to and upon all that other tract or body of Land consisting of (80) eighty acres, more or less, and lying likewise in said lots of Land numbers (254) Two Hundred and Fifty Four and number (255) two Hundred and Fifty Five, said District Section and County, which is described more fully in a certain deed made by the said O. F. Stephenson to the Federal Land Bank of Columbia and recorded in book 12 Page 275 of said deed records, the conveyance of said last named tract of 80 acres, being made subject to said last named deed made to said Federal Lnad Bank to secure loan, and the further consideration for this conveyance from the sum first named, distinguished, is that said G. W. Stephenson, Party of the second part, hereto will well and truly pay to said Federal Land Bank of Columbia, all sums of said loan, remaining unpaid, and shall promptly pay the same when due and shall observe all the requirements and stipulations of the contract loan, made by said O. F. Stephenson to and with said Federal Land Bank of Columbia, and upon the payment of said loan, by said party of the second part, said Federal Land Bank of Columbia is hereby empowered and directed to make and execute to said G. W. Stephenson proper and sufficient release and quiteclaim conveyance, vesting in him the named tract of land, as fully as the same was vested in the said O. F. Stephenson said conveyance to said bank. Witnesseth; That the party of the first part for and consideration of the sum of Eight Hundred Dollars in hand paid, the receipt whereof is hereby acknowledged, bargained, sold, and conveyed unto the said J. M. Echols, His heirs and assigns, all the parcel of land situated, lying and being in the county of Chattooga as follows; A tract of land, containing a fraction less than six tenths of and acre , a of land number (83) eighty Three in the 6th District and 4th section of Chattooga county, Georgia, and being bounded as follows; Beginning at a stake on the west side of the public road running north form Summerville to the Town of Trion, at the point where the line between C. W. The receipt whereof is hereby acknowledged, has granted, bargained, sold and conveyed and by these presents does grant, bargain, sell and convey unto the said party of the second part, heirs and assigns, all that tract or parcel of land lying and being in the 13th District and 4th Section of Chattooga County, Georgia, and being parts of original Land Lots Nos. 254 and 255 in said district and Section, and more particularly described as follows: bounded on the north by the lands of J.
