Harper of the county and state aforesaid of the other part. Witnesseth that whereas the said William Stroud Executor as aforementioned agreeable to an order of the Honorable Superior Court of said county when sitting for ordinary purposes at the November adjourned time thereof in 1834 and after duly and publickly advertising the same according to law did on the first Tuesday in February 1835 at the place of publick sales at the court parcels in the town of Watkinsville in said county expose for sale at public outcry all that tract or parcel of land belonging to the estate of the said Stephen Crow deceased situat lying being in the county of Clarke and Jackson in the state aforesaid on the waters of Pear Creek containing one hundred acres more or less and bounded as follows- Beginning at a post oak thence north 31 chains 65 links to a red oak thence west 31 chains 65 links to a pine thence south 31 chains 65 links to a pine thence to the beginning corner. Sold for the benefit of the heirs and creditors of the said deceased when the said James Gann and John W. Harper being the highest and best bidder the same was knocked off to them at and for the sum of twenty two dollars twelve and half cents- Now this indenture further witnesseth that the said William Stroud Executor as aforesaid for and in consideration of the sum of twenty two dollars twelve and half cents to him in hand paid by the said James Gann and John W. Harper this receipt whereof is hereby acknowledged hath granted land gained and sold and by and by these presents doth grant bargain and sell unto the said James Gann and John W. Harper their heirs executors administrators and assigns all the above described tract of land together with all and singular the rights members and appertenances to the same belonging or in any wise appertaining- To have and to hold the said tract or parcel of land with all and singular the appertenances aforesaid unto the said James Gann and John W. Harper their heirs and assigns forever in fee simple and the said William Stroud Executor as aforesaid the said tract or parcel of land with the appertenances aforesaid unto the said James Gann and John W. Harper their heirs executors administrators and assigns against the claim of all or every person or persons whatsoever shall and will warrant and forever defend as such Executor and no further. In witness whereof the said William Stroud Executor aforesaid hath hereunto set his hand and seal this day and year first before written- Signed Sealed and Delivered In presence of R.C.
