All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Wesley Gann http://www.genrecords.net/emailregistry/vols/00025.html#0006068 February 19, 2007, 4:31 pm Deed Book Written: 1904 Mrs. Florrie Gann To Athens Savings Bank October 20, 1904 Book SS, page 24 Clarke County, GA Deed is on a “pre-printed” form State of Georgia, Clarke County, This indenture made this the 20th day of October in the year of our Lord one Thousand Nine Hundred and Four between Mrs. Florrie Gann of the County of Clarke and State of Georgia of the one part, and The Athens Savings Bank, a corporation under the laws of this State of the County of Clarke, of the other part, Witnesseth: That the said Mrs. Florrie Gann for and in consideration of the sum of Three hundred fifty dollars in hand paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained, sold, and conveyed, and by these presents doth grant, bargain, sell, and convey, unto the said The Athens Savings Bank, its successors and assigns, all the following property, to wit: That lot of land, in Athens, Clarke County, Georgia beginning at a stone on Barrow Street, which stone is the South East corner of Misses Hales lot, and running along Barrow Street one hundred feet (100’) to a stone; thence N. 20 ea. Two-hundred and twenty six feet (126’) to the line of the Childs property: thence in a westerly directive along said property line one hundred feet (100’) to North East Corner of lot of Misses Hale S 20 E two-hundred sixteen (216’) along the line of Misses Hale to the beginning corner, containing one half acre more or less. To have and to hold the same, with all the rights, members, and appurtenances therein appertaining to the said The Athens Savings Bank, its successors and assigns, in fee simple, forever. And the said Mrs. Florrie Gann the said bargained premises unto the said The Athens Savings Bank its successors and assigns against the said Mrs. Florrie Gann, her heirs, executors, and administrators and against all and every other person or persons, shall and will warrant and forever defend the right and title thereto by virtue of these presents. This conveyance is made under sections 1969, 1970, and 1971 of the code of 1882, in regard of the sale of property to secure debts and to pass the title of the property described into the said The Athens Savings Bank, for the purpose of securing the following debt, to wit: A certain promissory notes made and delivered by Miss Annie F. Hale to said company, bearing even date herewith and payable to said company, or being and falling due on the 18th day of January 1904 Three Hundred and Sixty Dollars. Said notes are given to cover the repayments, by monthly installments, of a loan of money obtained from said company in accordance with its charter. It is hereby extremely agreed that if default shall be made in the payment of any one said note, and such default shall continue for the space of (blank) days after such note becomes due then each of said notes above mentioned shall thereby become due and payable, and the said The Athens Savings Bank if it’s board of directors shall so desire, may proceed to recover the whole of the money then unpaid, it being expressly understood that time is of the essence of the contract. And the said The Athens Savings Bank, its agent or representative, is hereby authorized and empowered, to sell at public outcry before the courthouse door in the city of Athens, county of Clarke, to the highest bidder for cash all of the aforesaid property for the purpose of repaying said loan together with the interest which may be legally due thereon and the expenses of the proceeding including ten per cent on the amount due as attorney’s fees, after announcing the time, place, and terms of sale in the newspaper in which the Sheriff of said county advertises his sales, once a week for four weeks. And the said The Athens Savings Bank, its agent or representative, may make to the purchaser or purchasers of said property good and sufficient titles in fee simple to the same, thereby diverting out of the said Mrs. Florrie Gann and Miss Annie F. Hale all right and equity that they on either on these may have in and to said property, and vesting the same in the purchaser or purchasers aforesaid. The proceeds of said sale are to be applied, first, to the payment of the said debt and interest and expenses of this proceeding, as aforesaid, and the remainder, if any, paid to Said Mrs. Annie F Hale And the said The Athens Savings Bank, it’s agent or legal representative, shall be authorized to proceed summarily to put the purchaser or purchasers in possession, the said Mrs. Florrie Gann and Mrs. Annie F. Hale covenanting and agreeing to surrender the same without let or hindrance of any kind. The power and agency aforesaid is coupled with an interest, and is hereby made irrevocable, even by death. But this method of realizing on said property shall be only cumulative of the other remedies allowed said The Athens Savings Bank under the laws of this State in such cases made and provided, which may be used at the option of the Board of Directors of said company.
