Smith Georgia Clarke County This indenture made and entered into on this August 3 A.D. 1904, between W.G. Gann of the county and state aforesaid of the first part, and Patrick L. Smith, of the same county and state of the second part. Witnesseth: that the said W.G. Gann for and in consideration of the sum of Two-hundred fifty ($250.00) dollars cash to him in hand paid by the said Patrick L. Smith at and before the signing, sealing and delivery of this writing, the receipt of which is hereby acknowledged, hath and does by this writing bargain sell alien and convey unto the said Patrick L. Smith, his heirs and assigns all the following described property, to-wit: A one half undivided interest in and to all that tract or parcel of land, situate lying and being in the 1467th G.M. District of said county and state containing 70 acres and known in said district and county as the “Billy Gann Dower” tract and bounded as follows} On the north by lands of Joe Smith and the Middle Oconee river: on the east by the lands of Wigley and Allen, and a small space of the Jos. Lee land, on the south by lands belonging to M.B. Morton known as the Arenia Autonia tract, and on the west by lands of Jos Smith and with meets and bounds clearly shown by reference to a map or plat of the same lately. To-wits on the 30th of July 1904, completed and filed in office by _______ Hemrick and Culp and land processioners of said district, and County surveyor Strahan (having lately conveyed a deed to the said Patrick L. Smith to the other one half undivided interest in and to said land). Now this deed is intended to convey unto him, his heirs and assigns all the interest of whatever kind legal or equitable I have or may have had in and to said land and premises pryor hereto; together all and singular the rights, members and appurtenances, thereto belonging./ To have and to hold the same freed from the claim or claims of any and all other persons whomsoever in Fee Simple, and the said W.G. Gann for himself, his heirs, executors, administrators and assigns, unto the said Patrick L. Smith, his heirs, executors, administrators and assigns, will and does by this writing forever warrant and defend the right title and interest of the said premises and property against the interests of themselves and any and every other person or persons whomsoever. In witness whereof the said W.G. Gann hereunto sets his hand and affixes his seal and delivers these presents on the day and date first above written Signed, sealed and delivered W.G. Gann (L.S.) In the presence of: Florrie Gann H.H. Winn Ga. Clarke Co.} Previously approved before the undersigned officer H.H. Wynn + after being duly sworn deposes and says that he saw W.G. Gann signed this written + foregoing deed for the purpose and in accordance therein specified. We saw the considerations paid in cash and in gold money on the day + date stipulated in said Deed: Making a clean clear cut deed to the property described in said deed.
