Witnesseth, that the said William L Mitchell for and in consideration of the sum of three thousand Dollars to him in hand paid at and before the sealing and delivery of these presents the receipt where of is hereby acknowledged as well as in consideration of the natural love and affection which he has bears to the said John F Mitchell his son hath given, granted, bargained and sold & conveyed and doth by these presents give grant bargain sell and convey unto the said John F Mitchell his heirs and assigns all that tract or parcel of Land situate lying and being in the County of Clarke and state aforesaid on the waters of Big & little Sandy Creeks & Nacatchee Creek, adjoining lands of M. Hunnicut, Wecky Nance, John White’s estate, William G Barrett, William Lampkin, Joseph Comer, T W Rucker, the Tolbot tract, Nathan Whitman, a person of color, Weatherly & Co. consisting of three tracts of land as herein more particularly described to wit, the tract conveyed to William Thornton by Ferdinand Phinizy and by William Thornton to James A Carlton, and by James A Carlton to said William L Mitchell and described by a plat of the same annexed to its deed from said Ferdinand Phinizy to Marco Phinizy, containing four hundred and thirty eight acres more or less, also a small tract or slip of land bounded as follows. Beginning on Big Sandy Creek at the corner of the tract before herein described and running down said Creek to a stake corner and thence North 52 10/ East 18 chains 15 links to a stake 30 links from the Second corner of said William L Mitchell at the end of the first line from the said Creek and thence a straight line 30 links joining these two stake corners. Containing three acres more or less on which line from the creek the fence now stands as it did when conveyed to said William L Mitchell by Sarah E Rucker Administratrix of Tinsly W Rucker deceased said three acres being cut off from the land of said deceased purchased of Asbury Howell & also the right of way from the Nowhere road thirty feet wide through the land of Tinsley W Rucker as described in the deed executed by him to said William L Mitchell his heirs and assigns dated June 22d 1874. The said first two tracts containing four hundred & forty one acres more or less. To Have and to Hold said tracts and right of way to him the said John F Mitchell his heirs and assigns together with all and singular the rights members and appurtenances thereof to the same in any manner belonging to his and their own proper use benefit and behoof forever in fee simple. And the said William L Mitchell for himself his heirs executors and Administrators the said bargained premises unto the said John F Mitchell his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatsoever. In Witness whereof the said William L Mitchell hath hereunto set his hand and seal this day and year first above written.
