All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 November 17, 2004, 12:44 am Written: June 22 1874 Recorded: July 4 1874 Clarke County Deed Book AA, Folio 249 – 250 Georgia } This Indenture made this twenty second day of June Clarke County} Eighteen hundred & Seventy four between Tinsley W Rucker of the one part and William L Mitchell of the other part both of the city of Athens in the County and State aforesaid Witnesseth that the said Tinsley W Rucker for and in consideration of Ten Dollars the receipt whereof is hereby acknowledged at and before the sealing and Delivery of these presents as well as of the wood and timber privilege granted to him by said William L Mitchell and acknowledged at the foot of this Indenture to wit the privilege of cutting and carrying away all the timber and wood on the strip of land lying between the Nowhere Road as it now runs and the line separating the land of said William L Mitchell and known as number five and the land of said Tinsley W Rucker said line being indicated by and old Ditch at any time for and during the space of Five Years to be computed forever the 1st day of January 1874 and to terminate on the 31st day December (1878) Eighteen hundred and seventy Eight said sta__ being in said County hath granted bargained sold and conveyed and doth by these presents grant, bargain, sell, and convey unto said William L Mitchell his heirs, and assigns the right of way over and through the said tract of land of said Tinsley W Rucker thirty feet wide and extending from said line between said parts along the route of the old Military Road towards Nocatchee Creek and terminating at the boundary line between said Tinsley W. Rucker and Alexander M Scudder opposite upon ridge on said Scudders land leading to the place of said William L Mitchell and Known as Egypt bought of James A Carlton To have and to Hold said right of way with all and singular the rights members & appurtenances thereto belonging to the proper use benefit and behoof of him the said William L Mitchell his heirs and assigns forever in fee simple and the said Tinsley W Rucker the said bargained premises and right of way unto the said William L Mitchell his heirs Executors and administrators and assigns against the claim of him the said Tinsley W Rucker his Executors & administrators and against the claim of all other persons whatsoever will warrant and forever defend by virtue of these presents In witness whereof the said Tinsley W Rucker hath hereunto set his hand & seal the day and year first above written Signed Sealed & Delivered in presence of Tinsley W Rucker S O Hutchason P W Hutchason Jr. Clerk Supr Court I William L Mitchell hereby acknowledge the grant of the privilege of cutting and carrying away the timber and wood as specified in the foregoing Deed -- Witness my hand and seal, this June 22nd 1874 Executed in presence Wm L Mitchell S.
