This Indenture, made this Eighteenth day of January in the year of our Lord one thousand eight hundred and thirty nine between Benjamin Towns of this county and State aforesaid of the one part and John Thurman of the other part witnesseth that the said Benjamin Towns for and in consideration of the sum of one hundred and thirty four dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and do by these presents grant bargain sell and convey unto the said John Thurman, his heirs and assigns, all that tract or parcel of Land situate lying and being in the county of Clark and the town of Athens and state aforesaid it being the one fourth part of a lot of land and known by number Nineteen as surveyed by James Meriwether and called a four acre lot and the sale herby made by Benjamin Towns To John Thurman is the north west corner or acre of said lot be the same more or less. To have and to hold said tract or parcel of land, unto him the said John Thurman, his heirs and assigns, together with all and singular the rights members and appurtenances thereof to the same and any manner belonging to his and their own proper use-benefit and behoof forever fee simple. And the said Benjamin Towns for himself, his heirs executors and administrators the said bargained premises unto the said John Thurman, his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever. Huggins & Woolsey Nichols & William S. Comstock, composing the firm of W. Nichols & Co-of the County and State aforesaid of the one part and William W. Clayton of the County of Clarke and State aforesaid of the other part. Witneseth that the said Benjamin Towns, John J. Huggins, Woolsey Nichols & William S. Comstock composing the firm of W. Nichols & Co. for and in consideration of the sum of Two Thousand Dollars to us in hand paid at and before the sealing and delivery of these presents, the receipt whereof is herby acknowledged hath granted, bargained, sold and conveyed, and do by these presents grant, bargain, sell and convey unto the said William W. Clayton, his heirs and assigns, all that tract or parcel of land, situate, lying and being in the County of Clarke and town of Athens known as lot number thirty (No. 30.) Mitchells Survey, containing one acre more or less, also all that part of lot number thirty one (No 31), which is within the present enclosure, extending to the fence dividing the premises from the remainder of that said lot number thirty one (No 31) at present owned by R. S. Sheats and M. M. Sheats. To have and to hold said tract or parcel of land, unto hum the said William W. Clayton, his heirs and assigns, together with all and singular rights, members and appurtenances thereof, to the same in any manner belonging to him and their own proper use, benefit and behoof forever, in fee simple. And the said Benjamin Towns, John J. Huggins & Woolsey Nichols & William S. Comstock composing the firm of W. Nichols & Co. for their heirs, executors and administrators the said bargained premises unto the said William W. Clayton his heirs and assigns will warrant and forever defend the right and title thereof, against themselves, and against the claim of all other persons whatever. This Indenture, made this fourth day of March in the year of our Lord one thousand eight hundred and forty four, between Benjamin Towns of the county of Clarke and State aforesaid of the one part, and Leonidas Franklin of the county and state aforesaid of the other part. Witnesseth that the said Benjamin for and in consideration of the sum of four hundred dollars to him in hand paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged hath granted, bargained, sold and conveyed, and doth by these presents grant, bargain, sell and convey unto the said Leonidas his heirs and assigns, all that tract or parcel of land, situate, lying and being in the county of Clarke & in the town of Athens in the survey of that part of said town known as Cobbham & known in said survey as lot number one hundred & thirty six (No. 36) containing three rows & eleven poles. To have and to hold said tract or parcel of land, unto him the said Leonidas, his heirs and assigns, together with all and singular the rights, members and appurtenances thereof, to the same in any manner belonging, to his and their own proper use, benefit and behoof forever in fee simple. And the said Benjamin for himself his heirs, executors and administrators, the said bargained premises, unto the said Leonidas his heirs and assigns, will warrant and forever defend the right and title thereof against himself & themselves and against the claim of all other persons whatever. Surnames: Towns, Sunkey, Watson, Daniel, Walker, Wall Georgia Greene County This Indenture, made and entered into between William D. Sunkey, Jesse H. Watson & William Daniell administrators of Drury Towns Decd. of the one part & Benjamin Towns of Clark County of the other. Witnesseth that whereas the said Drury Towns in his life time sold unto Benjamin Towns a certain tract of land lying in the County of Clark and town of Athens and executed his bond for titles to the same & whereas the Inferior Court of Greene Co. when sitting for Ordinary purposes in May Term in the year A. D., one thousand eight hundred & thirty four passed an order compelling his adm. to execute titles in terms of said Bond. Now this Indenture witnesseth that for and in consideration of the sum of two Hundred Dollars in hand paid at and before the sealing & delivery of these presents the right whereof is hereby acknowledged hath granted, bargained, sold, conveyed & confirmed and by these presents doth grant, bargain, sell, convey, and confirm unto the said Benjamin Towns his heirs and assigns all that tract or parcel of land containing one acre situate, lying & being in the town of Athens and County o Clark and known and distinguished in the plan of said town by number Sixteen (16) adjoining ________, Walker & Others. To Have and to Hold the said lot of land with all and singular the rights, members, appurtenances thereof whatsoever to the said Benjamin Towns, being, belonging or in anywise appertaining, with the rents paid and profits thereof to the only proper use benefit and behoof of him the said Benjamin Towns his heirs, executors, administrators and assigns in fee simple. And the said William D. Sunkey, Jesse H. Watson & William Daniel administrators of the said Drury Towns Dec'd. and his heirs, executors and administrators the said bargained lot of land unto the said Benjamin Towns his heirs and assigns, against all and every other person or persons shall and will warrant and forever defend as admns. by virtue of these presents. H. White, of the other part both of the state and county above mentioned, witnesseth that the said Benjamin Towns for and in consideration of the sum of one hundred and fifty Dollars, to him in hand paid the receipt whereof is herby acknowledged hath granted bargained and sold and do by these presence doth grant bargain and sell release and convey unto the said William H. H. White all that tract or parcel of land lying and being in the town of Athens and known and distinguished in the plan of said town as the north east corner of lot No (11) eleven of the new or Meriwether plan or survey containing one acre the same being more or less together with all and singular the rights titles members and appurtenances thereunto belonging or in any appertaining to him the said William H. H. White To have and To hold, the same to his own proper use benefit and behoof forever in fee simple. And the said Benjamin Towns shall and will warrant and defend the rights and titles thereof to the said William H. H. White his heirs executors administrators and assigns against the claim or claims of all every person or persons whatsoever. Recorded 13th Febry 1846 Deed Book R, page 374 Surnames: Towns, Tinsley, Huggins, Hendon, Nichols, Comstock, Sheats State of Georgia Clarke County, Whereas in Obedience to writs of Fierc Facias issued out of the Inferior Court of the County of Taliaferro at the suit of John J. Huggins and others against James Tinsley of Said County of Taliaferro I did lately Seize the Lot of Land hereinafter described as the property of the said James Tinsley and the said Lot of Land being duly and publicly advertised according to law was on the first Tuesday it being the fourth day of July in the year Eighteen hundred and forty three at the Court House in Said County of Clarke exposed to sale at public _______ when John J. Huggins being the highest and best bidder, the same was knocked off to him at the price of Nineteen hundred and ten dollars. Now This Indenture, made the Eighth day of September in the yea Eighteen hundred and forty three between James Hendon Sheriff of Said County of the one part and Benjamin Towns John J. Huggins & Woolsey Nichols and William S. Comstock Composing the firm of W. Nichols & Co. of the other part witnesseth, that the Said James Hendon Sheriff as aforesaid for and in Consideration of the sum of Nineteen hundred and ten Dollars, to him in hand paid the receipt whereof is hereby acknowledged, hath granted bargained and sold and by these presents doth grant bargain sell and convey unto the said Benjamin Towns, John J. Huggins & Woolsey Nichols & William S. Comstock Composing the firm of W. Nichols & Co. their heirs and assigns. So far as the Office of Sheriff authorizes him thereunto all that tract or parcel of Land, now lying being and situated in said County of Clarke and town of Athens known as Lot Number Thirty (No 30) Mitchells Survey Containing one acre more or less also all that part of Lot number thirty one (No. 31) which is within the present enclosure extending to the fence dividing the premises from the remainder of the said Lot number thirty one (No 31) at present owned by B. S. Sheats and M. M. Sheats. This title made by virtue of a written order in the following words, ___ Shff Clarke Co Execute titles to lot No 30 (Number thirty) in the town of Athens bid off by me at Sheriffs Sale on the first Tuesday in July last sold as the property of James Tinsley to Benjamin Towns John J. Huggins & Woolsey Nichols & William S. Comstock Composing the firm of W. Nichols & Co. August 17th 1843-Yours Truly, John J. Huggins with all and Singular the rights, members and appurtenances thereunto belonging or in any wise appertaining, and also all the estate, right, title, interest, property claim and demand of the said James Tinsley his heirs and assigns, in law, equity or otherwise whatsoever of in and to the same. To have and To hold, the said bargained premises unto the said Benjamin Towns John J. Huggins & Woolsey Nichols & William S. Comstock composing the firm of W. Nichols & Co. their heirs and assigns to their only proper use benefit and behoof forever in fee Simple, in as full and ample a manner as the said James Tinsley his heirs and assigns did hold or might have held and enjoyed the same, had it not been Seized and Sold under Execution as aforesaid. Recorded 21st Sept 1843 Deed Book Q, Page 47 Surnames: Towns, Harris, Hillyer, Lasiter, Newton, Hamilton Georgia, Clarke County This Indenture made & executed this Eighth day of July Eighteen hundred and thirty six between Benjamin Towns of the County aforesaid of the one part and Thomas W. Harris of the County of Walton of the other part. Witnesseth, that the said Benjamin Towns for & in consideration of the sum of One thousand Dolls to him in hand paid by the said Thomas W. the receipt whereof is hereby acknowledged hath granted bargained sold & conveyed & by these presents doth grant, bargain, sell & convey unto the said Thomas H. his heirs & assigns all that tract or lot of land situate in the town of Athensnow in the possession of James Hillyer & knows in the plan of sid town as (Lot No 16) the east line whereof is the dividing fence between the sait lot & Col Hamiltons lot running from the west end of the said Hamiltons stable to a post about eight feet east of the sid Hillyers office containing about one acre. To have & to Hold, the said lot of land together with the appurtenances thereto belonging unto the said Thomas W. his heirs & assigns forever in fee simple. And the said Benjamin Towns for himself his heirs, executors & administrators the said lot unto the said Thomas W. his heirs & assigns will forever warrant & defend against the claim of all persons whatever.
