H. TOWNS TO Peter Flanigan. GEORGIA ) CLARKE COUNTY. ) THIS INDENTURE, made and entered into this the 12th, day of February, in the year of our Lord one thousand nine hundred and eighteen, between A. S. Towns, of said State and County, the duly constituted administrator of the estate of J. H. Towns, deceased, late of said county, party of the first part, and Peter Flanigan, of said State and County, party of the second part. WITNESSETH: That the said party of the first part by virtue of an order granted by the Honorable Court of Ordinary of said Clarke County, Georgia, on the first Monday in October, 1917, previous notice of application for leave to sell the land hereinafter described, belonging to the estate of said deceased, haveing [sic] been given by publication, as required by law, did on the first Tuesday in November, 1917, within the legal hours of sale, at the place of public sales, to-wit, before the courthouse door in Athens, Georgia, put up and expose for sale at public outcry to the highest bidder, after said sale had been duly advertised by publication as required by law and after all requirements of law had been fully complied with: That tract of land located in the County of Clarke on the waters of Cedar Creek and on the north side of the public road leading from Georgia Factory to Lexington, being located about five miles from the city of Athens, and bounded as follows: On the North by lands owned by Dean and by Smith; on the East by lands owned by Dean; on the South by lands owned by Lester and Smith; formerly by Martha A. Williams, on the west by lands of A. S. Towns, formerly owned by J. R. White; being the old Tom Moore place and other lands formerly owned by Willis Kittle and not owned by A. S. Towns, and enclosed by lines as follows, to-wit: Beginning at a pine corner near and on the North side of said mentioned public road, and running thence N. 48W. 2915 feet to a red-oak stump, being corner of James H. Towns; thence S. 40½ W. 1515 feet to a stone on the branch, said branch being part of the headwaters of Cedar Creek; thence S. 70½ W 271 feet to the branch; thence S. 64¾ W. 112 feet to a bench on the branch; thence S. 69 W. 126 feet to bench; thence S. 55¾ W. 262 feet to bench; thence S. 67½ W. 144 feet to bench; thence S. 71½ 157 feet to bench; thence N. 62½ W. 125 feet to bench; thence S. 72 W. 59 feet to black-gum, corner, said last described lines from stone at the branch down to the last mentioned corner being a line running near the direction of the branch, and the last mentioned corner being formerly Willis Kittle's corner; thence S. 2¼ W. 940 feet to a hickory on the north side of said road; thence S. 79¾ E. 2275 feet along Georgia Factory road to a bend in said road; thence S. 43¾ E. 219 feet along said road to Cedar Creek; thence S. 76 E. 28 feet to a bend in said road; thence N. 43½ E. 320 feet along the meanderings of said road to a bend; thence N. 40½ E 180 feet along the meanderings of said road to a bend; thence N 43¼ E. 425 feet along the meanderings of said road to bend; thence N 82 E 436 ft along the meanderings of said road to bend, thence N 71½ E 866 feet along the meanderings of said road to Dean's line; thence N 28 E. 53 feet to the beginning pine tree corner; said tract of land containing one hundred and fifty one & 38/100 (151.38) acres, agreeable to a survey made December, 1892, by C. W. Strahan, County Surveyor, And being part of the William Kittle tract, and known as the homeplace; when the said lot or parcel of land above described was bid off by the said party of the second part at the price or sum of None Thousand Eight Hundred and Thirty-nine & 70/100 ($9,839.70) Dollars, being the highest and best bidder. AND WHEREAS on the 14th day of December, 1917, the said A. S. Towns, administrator of J. H. Towns, filed in Clarke Superior Court an equitable petition against the said Peter Flanigan, etc., and on the 6th, day of February, 1918, a judgment and decree of the court was rendered in said case, his Honor Judge Andrew J. Cobb, then and the presiding, in which said sale was confirmed and direction the said administrator to convey said land to the said Peter Flanigan upon the payment by him of the amount bid at said administrator's sale, which under said decree "shall best the said Peter Flanigan with as full and complete title to said land, free from all liens, claims or encumbrances whatever." NOW THEREFORE, the said party of the first part, in consideration of the premises and in compliance with said judgment and decree of the court, and for and in consideration of the sum of $9,839.70 in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained and sold, and does grant sell and convey unto the said party of the second part the said Peter Flanigan, his heirs and assigns, members and appurtenanced thereto belonging or in anywise appertaining; to his own proper use, benefit and behoof forever in as full and ample a manner as the same was possessed or enjoyed by the said J. H. Towns, deceased, in his lifetime. IN WITNESS WHEREOF, the said part of the first part has hereunto set his hand and seal, the day and year first above written. A. S. Towns (L.S.)
