Barrow, Sr, Clarke County, GA Court of Ordinary, Will Book B, 1885-1911, page 257. State of Georgia, County of Clarke, I David C. Barrow of the County of McIntosh, in said State, being of sound and disposing mind and memory, do make, ordain, publish, and declare this my last will and testament, hereby expressly revoking all previous wills and codicils by me heretofore made, Item first, I direct that all my just debts if there be any be paid, Item second I give to my beloved wife all my household and kitchen furniture where ever situated absolutely to do with as she pleases. Item third, I give my gold watch to my son Pope. Item fourth, It is my will that during the life or widowhood of my beloved wife the entire net increase of the Sylls Fork Place (Plantation) in the County of Oglethorpe, shall belong and be devoted to the support of my said wife and my daughter Nelly Spalding, upon the death of my said wife or in the event of her marriage, I direct my Executor to divide the said place equally between all my children and descendants of deceased children, the latter taking per stipe(?). Necessary repairs and taxes may be deducted from the rent, issues and profits of the said Sylls Fork Place before the said issue is paid over to my said wife and daughter above provided. In order to carry out this legacy during the life or widowhood of my said wife, my Executor is authorized to rent, lease or farm said place, as in his judgment may be best for the interest of my said wife and daughter, and to manage the same during her life, and widowhood of my said wife, paying over the same to thus annually during said period the net incomes as above provided. In order to effectuate this institution he is clothed with entire authority during the life and widowhood of my said wife, to make any and all contacts necessary and proper. Item fifth, In making the division provided for at the death or marriage of my said wife, my Executor may sell, if in his judgment it should be necessary to do so the whole or any part of said place at public or private sale without any order of Court his deed to pass a perfect title to the purchaser. Item sixth, All the rest and residue of my estate, both real and personal, I wish divided equally between all my children and descendants of deceased children, the latter taking per stipe(?), and in making this division, also I clothe my Executor with the same directive and the same power of sale as in item fifth. Item seventh, I nominate and appoint my son David C. Barrow Jr., Executor of this my last will, and release him from the duty of making inventory, and having any appraisement of my estate and also from making any returns to any Court or officer. Barrow as his last will and testament, this 20th day of August in the year of our Lord Eighteen hundred and ninety in the presence of us who at the same time signed the same as subscribing witnesses in his presence at his request and the presence of each other. Palmer, named as a witness to the within writing purporting to be the last will of David C. Barrow, Sr. and being duly sworn, saith, that he with John Crawford and Geo. Dudley Thomas, a the request of said D. C. Barrow Sr and in his presence and in the presence of each other did attest the within writing as his will, that the same was signed and published by him in their presence as his last will, that he was at the time of said attestation and signing by him of sound and disposing mind and memory, that he executed the within paper voluntarily. Barrow Jr. nominated Executor of the last alleged will of David C. Barrow S. duly filed, having been appointed by proper proof of H. R. Palmer a witness to said will that said David C. Barrow Jr. died a resident of said County, that he and the other witnesses at his request and in his presence with John Crawford and Geo. Dudley Thomas as attesting at his request, that said David C. Barrow Sr. was at the time of said signing and attestative of sound and disposing mind and memory, and did in the execution of said will ask freely and voluntarily it is ordered that the same be duly recorded having been duly proved in common form, and that letters testamentary may issue to him upon his taking the usual oath of office.
