Childs, Clarke Co., GA Will Book E (1885-1911), Pages 312-313 Court of Ordinary State of Georgia, Clarke County Last Will and Testament of Asaph K. Childs of said State & County. I Asaph K. Childs of Athens, Clarke County, Georgia, being of sound mind and testimony do make & publish this my last will & testament and hereby revoke all other wills heretofore made by me: Item 1st I wish my just debt all to be paid; Item 2nd I give and bequeath to my daughter Francis C. Barrow my house and lot on Milledge Avenue, Athens, GA-known in Athens City________ Enumeration as No. 6 North -- Milledge Avenue being the house and all contiguous land and other improvements thereon, and now rented to and occupied by Judge Howell Cobb and bounded on north by lot of H. H. Linton Trustee, west by Milledge Avenue, south by Broad Street and east by unimproved lot owned by my son-in-law Professor David C. Barrow-to be held & owned by her and her heirs and assigns in fee simple; Item 3rd I give and bequeath to my son Walter L. Childs my plantation in Clarke County, Georgia, known as the Joe Morton Place and to be held and owned by him and his heirs and assigns in fee simple; Item 4th I give and bequeath to my grandchildren Susie D. Barrow, Benjamin N. Barrow, Elena P. Barrow and David F. Barrow- children of my daughter Mrs. Francis C. Barrow each three shares each of the Capital stock of the National Bank of Athens (Georgia) stock (now standing in my name on books of said Bank & owned by me) and the total legacy under this Item 4th being Twelve (12) shares of said stock; and each of my said grandchildren named to take and hold as in fee simple, separately his or her, their shares of said stock to him or her respectively, or his or her heirs & assigns as in fee simple; Item 5th I give & bequeath to the Wardens and Vestry of Emmanuel Parish in Athens (Georgia) the sum of Five Hundred Dollars; Item 6th All residue of my property in possession, expectancy, remainder or reversion: and all property and rights of property vested in me: and not herein before specifically mentioned and bequeathed-I give and bequeath in equal shares, one half each, to my children Francis C. Barrow and Walter L. Childs, each to take his or her one half in fee simple to him or her and his or her heirs & assigns; Item 7th I nominate my son-in-law Prof. David C. Barrow and my son Walter L. Childs to be Executors of this my last will and testament: and relieve them from giving any Bond: and relieve them from making any Inventory of my Estate or any Returns of this management of by Estate to the Court of Ordinary, or any other Court whatever other than they or either of them may voluntarily do: and should they or either of them make an inventory & file same as provided by law, this act shall not be construed to require this or either of them to make any Returns: Nor shall they or either of them be required to make any further returns should they or either of them at any time voluntarily make any one or more returns: In witness whereof I Asaph K. Childs have this 5th day of August, in the year of our Lord Nineteen Hundred and One (1901) have hereto signed my hand & my seal officially. A. K. James White A. S. Packer Jno. White Morton Georgia } Clarke County } I Asaph K. Childs do make this as a Codicil to my last Will & Testament made & executed, August 5th 1901-Nineteen Hundred & one. I republish that will and add thereto this clause to wit: I nominate and make my son-in-law Prof. David C. Barrow to be Testamentary Guardian for his and my daughter Mrs. Francis C. Barrows minor children, to wit-Benjamin H. Barrow, Elena P. Barrow and David F. Barrow, without Bond and relieve him of making any Return to any Court whatever as such Guardian, and give him power or permission to sell & transfer the National Bank Stock left each of my said grandchildren for reinvestment or for their use in his judgment but without any Order of any Court whatever: and to make any & all changes of Investment of said funds as he thinks best, without review of any Court, and to draw all dividends as now invested under the same direction without Return to any Court whatever.
