R. Cobb, 1863: Clarke Co., GA Last Will and Testament of Thomas R. R. Cobb Clarke County, GA Court of Ordinary, Will Book D, 1859-1885, pages 127&128. Georgia } In the name of God, Amen! Clarke County} I hereby declare & publish this as my last Will & Testament. First I appoint my Wife Sole Executor of this Will. I desire her to make inventory & appraisement of my estate & afterwards to make no Returns to the Court of Ordinary except as she sees proper; Second I give my Executor full power to sell any portion of my Estate at public or private sale at her pleasure & to Re-invest the proceeds at her pleasure. I charge her with the support & education of my children & further than this ask no account of income from her; Third As each of my children arrives at age or marries with her consent, I desire that my wife will apportion to each child one equal portion of my estate (not estimating the homestead- the house furniture & the company of house servants) as it may the exist, in her hands & under the management of my wife together with the unexpended increase thereof- the same to be held for the separate use of daughter- with power of disposition by her as may be provided in a proper marriage contract, or post- nuptial settlement; Fourth I Charge (word) my children to be kind, loving, obedient to their Mother (several illegible words) or appreciates except myself; Fifth At the death of my wife I wish her to dispose of her part of my Estate as she sees proper-except, the house-Furniture and House Servants excepted in the division. These I desire shall be thus divided among my children. Sixth I desire here to Record my gratitude to God for all this goodness & Mercy which has followed me all the days of my life from my first breath when kind affectionate parents watched over & guarded me-to the present moment. I desire to Record my abiding faith in the Christian Religion my confidence in the Redeeming power of the bastion(?) of my Lord & Savior & to (word) my only hope of salvation to be through faith in His name. I believe that if I Remain steadfast I shall yet see Him crowned with power and glory & think, with my loved ones who have gone before & all this Redeemed of the Lord. I shall be permitted to spend a happy eternity in His presence. O, the Divine God be (word) & glory & power & forever Amen! Lumpkin } Georgia } Clarke County } Personally appeared before me William W. Lumpkin one of the subscribing witnesses to this within and foregoing Will of Thomas R. R. Cobb late of said County deceased who on Oath saith that he saw said Deceased sign and seal said instrument and signed, sealed, declared the same as his last will and testament that at the time of his so doing he the Dictator was of sound and disposing mind and memory, that he (can't read word); Junius Hillyer and James M. Lumpkin all signed the same as witnesses in the presence of each other & of the Dictator and at his request. Sworn to and Subscribed before us this 30th day of January 1863} William W. Lumpkin Asa M. Cobb late of said County Deceased together with this matter probate thereof, being presented in open Court, and offered for approval and Record. On examination thereof, it is ordered and consigned by the Court that said Will is in (word) form is proved and that the same together with said probate be admitted to Record the terms of the law.
