Hill, Clarke County, GA Court of Ordinary Will Book E (1885-1911), Pg. 368. Georgia-Clarke County.} I Walter B. Hill do execute this my last will. Item 1st It is my desire that all my just debts be paid as soon as practicable after my death. Item 2nd I desire and bequeath all the property real and personal that I may own at the time of my death to my wife Sallie B. Hill for and during her life, that at her death to the children of our present marriage: the children of any deceased child to take that share of the parent per _____: and I hereby appoint my wife as trustee of the children and ________of children, giving her the power to sell and dispose of any of said property for purposes of reinvestment at public or private sale in her discretion and without any order of Court. Item 3rd I now have the following Life Insurances: (a) Policy in the Aetna Life Insurance Company No: 95376: This policy I assigned October 20, 1893, to my wife and children: Amt. $5,000.00 (b) Paid up policy in Equitable Life Assurance Company No. 137962 payable to my wife and surviving children. Amt. $9118.00 (c) Policy in the Royal Arcanum. No. 6980 payable to my wife and children. Amt. $3,000.00. I hereby appoint my wife guardian of my children who may be minors, to receive any portion of the proceeds of said policies coming to such children. And, she is hereby relieved from giving bond. I also appoint my wife Executrix of this will with power of sale at public or private sale in her discretion. In testimony whereof I have hereto set my hand and seal to this my will and publish the same as my last will and testament, in the presence of the witnesses whose names are undersigned. This the 3rd day of October 1904. Walter B. Hill Signed, Sealed, Published and Declared by the above named Walter B. Hill as his last will and testament in the presence of us, this Third day of October 1904-who at his request and in his presence hereby signed our names as subscribing witnesses; he first signing in our presence and we then signing in his presence and in the presence of each other. Hill's last will and being duly sworn, saith that he with E. R. Hodgson and A. E. Griffith sat the request of said Walter B. Hill and in his presence, and in presence of each other, did attest as witnesses the within writing as Walter B. Hill's will: that the same was signed and published by said Walter B. Hill in their presence as his last will: that he was at the time of said attestation and signing by him of sound and disposing mind and memory: that he executed the within paper voluntarily. T. L. Mitchell (sig) Sworn to & subscribed before me This 24 day of January 1906} S. B. Wingfield, Ordinary Clarke Court of Ordinary. January Term 1906-The above Petition of Mrs. Sallie B. Hill nominated Executrix of this last alleged will of Walter B. Hill duly filed having been supported by proper proof of T. L. Mitchell, a witness to said will, that witnesses E. R. Hodgson and A. E. Griffith saw him sign and heard him publish the alleged will as his own last will, that he attested the same as a witness at his request and in his presence with E. R. Hodgson and A. E. Griffith so attesting also at his request: that said Walter B. Hill was at the time of said signing and attestation of sound and disposing mind and memory, and did in the execution of said will act freely and voluntarily, it is Ordered that the same be duly recorded; having been duly proved in Common Form; and that Letters Testamentary issue to her upon her taking the usual Oath of Office-S. B. Wingfield, Ordinary. (sig) -Oath-Georgia, Clarke County} I do solemnly swear that the writing contains the last will of the within named Walter B. Hill, deceased, so far as I know or believe, and that I will well and truly execute the same in accordance with the laws of this State. So help me God. Sallie B.
