As to my debts I have none so far as I know or believe having made it the role of my life to owe no man any thing but love: and I would advise my children to act upon this precept. I give all my property real and personal of whatsoever kind owned by me at my death to my beloved wife for and during the term of her natural life to dispose of the whole or any part thereof to her own use or for the use of any or all of my children or grandchildren or for the use of any other person whatsoever by deed or will or by any other way that she may see fit-without impeachment of waste or accountability to anyone. An experience of fact, five years having fully justified this confidence. Should my wife however depart this life without making such disposition by gift or otherwise then my desire and will is that the whole of my estate left at her death be equally divided between my six single sons, to wit: Edward P. Lumpkin, James M. Lumpkin, Miller G. Lumpkin, Charlie M. Lumpkin, Robert C. Lumpkin and Frank Lumpkin. Share and share alike or in such other way as they may prefer, all of them being of age and capable of acting for themselves. Should they prefer a division in kind very well, but if they cannot agree amongst themselves then the whole to be sold and the proceeds equally distributed between them. I hereby nominate and appoint my beloved wife Callendar C. Lumpkin sole Executrix of this my last will, hereby revoking expressly all others heretofore by me made and it is my desire that she be relieved from the trouble of making and returning an inventory of my effects and from making an ___ of returns to the Ordinary of her actings and doings. Fellows one of the subscribing witnesses to the within and foregoing will of Joseph Henry Lumpkin, late of said County; Deceased who an oath saith that he saw said Deceased sign and seal said instrument and heard him acknowledge the same to be his last will and testament that at the time of so doing said Testator was of sound and disposing mind and memory, that he appointed William S. Hemphill and Henry Jackson all signed the same as witnesses in the presence of each other and of the testator and at his request. - George P.
