The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Last Will and Testament of Frank Lumpkin, Clarke County, GA Will Book D (1859-1885), Pages 347-348 Georgia } Clarke County } I Frank Lumpkin of the County of Clarke of said State and County being of sound & disposing mind and memory do make, declare & publish this as my last Will and Testament, hereby disposing of all that property of which I may be received and possessed or entitled and hereby revoking all previous Wills heretofore made by me. First I give and bequeath absolutely all my Estate of every character of property whatever to my beloved Wife Mrs. Katherine Dewitt Lumpkin and our little daughter Julia Wilcox Lumpkin and any other child or children that may be born to us either during my life or after my death share and share alike. Second I appoint my beloved Wife Mrs. Katherine Dewitt Lumpkin Testamentary Guardian for the farms and property and our daughter Julia Wilcox Lumpkin and also Testamentary Guardian for every and all other child or children born to us. Third I appoint my Wife Mrs. Katherine Dewitt Lumpkin my sole Executrix of this my Last Will and Testament and give her full authority to carry out all contracts made by me and to discharge all liabilities against me and to settle with my brother as Administrator of the Estates of my Father, Mother and Brothers authorizing her to exercise a liberal discretion in said settlements. Fourth I Relieve my Executrix and Testamentary Guardian for my children my Wife Mrs. Katherine Dewitt Lumpkin from making any Returns to the Court of Ordinary or other Court during her Widowhood other than to file the usual inventory of my Estate. In witness whereby I have Surely and Securely set my Hand and Seal this the Second day of October 1876. F. Lumpkin (Seal) The above and foregoing signed, sealed, declared & published by Frank Lumpkin as his last Will and Testament in our presence in we have each subscribed the same as witnesses at his Request and in his presence and in the presence of each other this Second day of October 1876. Hull two of the subscribing witnesses to the within and foregoing Will of Frank Lumpkin late of said County deceased who on Oath depose & say they saw said Deceased sign and seal said instrument and heard him acknowledge the same to be his Last Will and Testament, that he did so freely & voluntarily of his own free will and accord without any compulsion or persuasion on the part of any person or persons whatever. That at the time of so doing he was of sound and disposing mind and memory. That Affiants(?) and John M.
