Lumpkin, Clarke County, GA Court of Ordinary, Will Book D (1859-1885), Pgs. 146-147 Georgia } Clarke County } In the name of God, Amen. I Samuel P. Lumpkin of the county and State aforesaid being of sound mind and disposing memory do make, ordain, publish and declare this to be my last will and testament in order of my entering the service of my country and the uncertainty of all earthly things. Item 1st I command my soul to that God who gave it and my body to my friends and relations to be buried in a decent manner. Item 2nd I wish all my just debts paid. Item 3rd I give and bequeath all my Estate real, personal, or negroes (?) after the payment of my debts to John Calvin Johnson as trustee for his wife Matilda H. Johnson of the county and State aforesaid for the sole and separate use and to be disposed of as she pleases for she has been to me a mother for several years past both in affection and in every kindness that I could ask or she could anticipate and or cause. I believe if I were to die or be reduced to helpless suffering she of all others would most deeply deplore my loss or be most willing to relieve my necessities and should her said husband John Calvin Johnson survive her then to him give of thy trust for I believed that he will do with it what is right. Item 4th I hereby nominate, constitute and appoint my friend John Calvin Johnson Executor of this my last will & testament. In witness whereof I have hereunto set my hand and seal this 1st day of March 1862. Signed, Sealed and Delivered, Acknowledged, Published and } Samuel P. Personally appeared in open court David H. Winn one of the subscribing witnesses to the within and foregoing will of Samuel P. Lumpkin late of said county deceased who on oath sayeth that he saw said deceased sign and seal said instrument & heard him acknowledge the same to be his last will and testament that at the time of so doing he the Testator was of sound and disposing mind and memory that he deposent(?) Milledge S. Durham and Robert R. Hardin the other two witnesses to said will sign the same as witnesses in the presence of each other and of the Testator and of Testator's request.
