Will of Maj. Thomas Mitchell, 1836, Clarke Co. GA Submitted by: Sue Meinhart WILL, CLARKE CO., GEORGIA - dtd 1 Nov 1836 & proved July Term 1852 (probated 19 Nov 1852 per Mary Jean C.Voegtlin) I Thomas Mitchell of the County and State aforesaid do hereby make my last Will and testament in manner and form following that is to say: As my Several children have married I have already given them the following property to wit, My son Wm L. Mitchell a negroe girl Jelenia and five hundred dollars in cash, My son Madison Redd Mitchell one negroe boy Aderson, and five hundred dollars in cash, My daughter Sarah who intermarried with John Park, and who has Since died (leaving one child Sarah Anne Park) I have given one negroe girl Anne and Sundry articles of house hold furniture and the said negroe girl Since having a child Lloyd, this property being in possession of said Park so long as to vest the title in him, I have no control over it but hope on the marriage of his said daughter Sarah Anne Park, that his wife give said negroes as the value thereof to her. My son Jonathan I have given one negroe boy Anthony and also a negroe girl Margaret, with Sundry other articles together with said girl worth five hundred dollars. My Son Giles, I have given one negroe boy Martin. My son, Archelaus Hughes I given one negroe girl Cordelia, My Son Samuel Dalton Mitchell married in South Carolina and died without Issue; having left a widow who is already well provided for, I deem any provision for her by me unnessary. My daughter Charlotte having intermarried with Rich'd D. Winn I have lent her during my pleasure, two negroe girls Emmily & Dafney; also given her Sundry articles of house hold furniture; After my death I hereby give and bequeath unto my said daughter Charlotte Winn and the heirs of her body the said negroes Emmely & Dafney and their Increase. But if my daughter dies without Issue then said negroes to be returned to the estate and to be disbributed as the rest of my property. I give and bequeath unto my son Thomas Appling Mitchell one negroe girl Francis. I also give unto my grand daughter Saran Anne Park Six hundred dollars in cash. Having provided as I think equally for my Several children, my younger Sons having received a classical education, I have given them Something less than the rest. Now it is my desire that after the death of myself and wife the balance of my estate both real and personal, be equally divided among all my children and their lawfull heirs to wit. William Letcher Michell, Madison Redd Mitchell, Jonathan Mitchell, Giles Mitchell, Archelaus Hughes Mitchell, Charlotte Winn and Thomas Appling Mitchell. Should my wife be the longest liver I desire that all my property be kept together during her pleasure having regard to my Just debts, my condition to the benefit of the estate by selling any past thereof for that purpose, reserving to my wife the power of keeping such as She may desire and finally I appoint my three Sons Wm L.
