H. Towns— I,__ W. H. Towns of said State and County, being of sound and disposing mind and memory, do make this my last will and testament, herby revoking all wills heretofore made by my. Item 1—I wish my Executrix as soon as possible after my death to pay my debts. If a sale of property shall be necessary, I wish her to select for sale that which can be most advantageously used for that purpose, and I authorize her to sell the same at public sale as she may see fit. Item 2—I will to my beloved wife Susan Towns all of my real estate as long as she lives and remains a widow: if she should marry again, I wish the income of my plantation, known as the Macon Place, to go to the support of my minor children. Item 3—I wish my Executrix to sell of my perishable property and use the money for the support of her and my minor children. Item 4—I do hereby appoint my wife Susan Towns Executrix of this my will. I do not require her to make any Bond; nor make any returns to the Ordinary. In Testimony whereof, I have set my hand. This 1st day of October 1908. W. H. Towns [signed] Signed and published by W. H. Towns as his last will and Testament in the presence of the undersigned who subscribed over names hereto as witnesses, at the instance and request of said testator; and in his presence and in presence of each other. This the 1st day of October 1908.— B. J. Smith Peter Flannigan Chas. C. Echols W. A. Phillips State of Georgia, County of Clarke. Before me cam B. J. Smith and W. A. Phillips named as witnesses to the within writing, purporting to be W. H. Towns’s last will, and being duly sworn, saith that they, with Peter Flannigan and Chas. C. Echols and at the request of W. H. Towns and in his presence and in presence of each other, did attest as witnesses the within writing as the said W. H. Towns’s will: that the same was signed and published by W. H. Towns in their presence as his last will: that he was at the time of said attestation and signing by him of sound and disposing mind and memory: that he executed the within paper voluntarily. Sworn to & subscribed before me, B. J. Smith This 6th day of December 1909 W. A. Phillips S. B. Wingfield Sr. Ordinary Clarke County. Court of Ordinary, Dec. Term (6th) 1909— The above petition of Mrs. Susan Towns, nominated Executrix of the last alleged will of W. H. Towns, duly filed, having been supported by ______ proof of B. J. Smith and W. A. Phillips, as witnesses to said will, that said W. H. Towns died a resident of said County: that they and the other witnesses, Peter Flannigan and Chas. Echols saw him sign and heard him publish the alleged will as his own last will: that they attested the same as witnesses at his request and in his presence with Peter Flannigan and Chas. Echols so attesting also at his request & that said W. H. Towns was at the time of said signing and attestation, of sound and disposing mind and memory and did in execution of said will act freely and voluntarily: it is ordered, that the same be duly recorded: having been duly proved in __________: and that Letters Testamentary issue to her upon her taking the usual oath of office. Towns, deceased, so far as I know or believe, and that I will well and truly execute the same in accordance with the laws of this State. So help me God.
