Watters, party of the second part, his heirs and assigns, in the penal sum of eight thousand ($8,000.00) DOLLARS, for the payment of which well and truly to be made, the said party of the first part hereby binds her heirs, executors and administrators, jointly, severally and firmly by these presents, signed with her hand and sealed with her seal, this 14th day of November, in the year of our Lord One Thousand Nine Hundred and nineteen. THE CONDITION of the foregoing obligation is, That whereas the said party of the first part has this day agreed to sell to the said party of the second part a certain tract or parcel of land situated, lying and being in Land Lot Fifty-two (52) of the Thirteenth (13th) District of originally Henry, now Clayton County, Georgia, and described as follows: Beginning at a point in the center of the road where the original line crosses the Forrest Park Road, and running thence southwesterly along the center of said road three hundred and eight (308) feet; thence north two hundred and eleven feet and five inches (211 ft. 5 in.); thence west seven hundred and fifty-five (755) feet to the center of the National Highway; thence northwesterly along the center of said road seven hundred and forty-five (745) feet ; thence east five hundred and twenty-eight (528) feet and one (1) inch; thence northeasterly two hundred and ten (210) feet to the right of way of the Central of Georgia Railroad; thence along said right of way seven hundred and ten (710) feet and ten (10) inches; thence south five hundred and ninety (590) feet to point of beginning, being part of the tract conveyed by warranty deed from John F. Jones to R. J. Wright, and recorded in the Clerk’s Office of Clayton County, Georgia, in Book “S”, page 109, this tract containing twenty (20) acres, more or less, for the consideration or sum of four thousand ($4,000.00) DOLLARS, said sum to be paid as follows: Eight hundred dollars on or before the 15th day of November, 1920, and eight hundred dollars on the 15th day of November of each of the years 1921, 1922, 1923, and 1924, respectively. For which deferred payments the said party of the second part has given his 5 promissory notes, dated this day bearing interest at the rate of eight per cent, per annum from this date until paid, and stipulating that said party of the second part shall pay attorney’s fees and cost of suit, should suit be instituted. Now if the said party of the second part shall well and truly pay the said several sums of money at the times specified, then the said party of the first part is bound to make and execute to the party of the second part or his assigns a good and sufficient title to the above described lot or parcel of land; but on failure of the said part__ of the second part to pay the said sums of money or either of them at the times specified, then the said obligation to be void and of no effect.
