Chapman Transcribed by William L. Stephenson, Jr. January 2002 I, John H. Chapman, a resident of Clayton County, Georgia, do hereby make and publish this my Last Will and Testament. Item One. I will that after my death my executor hereinafter named shall pay all of my just debts. Item Two. As to land owned by me it is my will and desire that my heirs hereinafter named, shall sell same at private sale if possible. It is my desire that they shall sell my 150 acres farm in two tracts, the first to contain 114 acres and to consist of 100 acres bought by me from David Huie and 14 acres more or less bought from Penelope Swinney, and the second tract to consist of 30 acres bought by me from Yancy estate and 8 acres bought from Adam Turnipseed. If my heirs at law named in this will cannot agree on a private sale of the land, then it is my will and I expressly direct that my Executor hereinafter named shall have the right and authority to sell same at the Courthouse door of Clayton County, Georgia after advertising same once a week for four weeks, said sale to be on a regular sales day, and for his authority to sell said land he shall not have to apply to any Court for any order concerning sale. Item Three. After the sale of the land I will and direct that the proceeds of said sale be equally divided into four parts or shares and that one share be given to Augustus H. Chapman, or his heirs, one share to be given to John W. Chapman or his heirs, one share to be given to Mrs. Grace Adamson or her heirs and one share to be given to Mrs. Jessie hardy and Millard Chapman or their bodily heirs, daughter and son of my deceased son Oscar R. Chapman, the first three persons herein mentioned being my sons and daughters, respectively. In the calculation of the amount going to each person named in this paragraph the following advancements are to be considered and deducted: Augustus H. Chapman has received from me the sum of $1415.00 for which I hold his note; John W. Chapman has received from me the sum of $1500.00; Mrs. Grace Adamson has received from me the sum of $1362.25; for which I hold her note and Mrs. Jessie Hardy has received from me the sum of $175.00 for which I hold her note. I hold note signed by John W. Chapman for amount advanced to him. Item Four. I will and direct that my executor hereinafter named collect all debts owing to me on open account, notes and mortages and the proceeds of same is to be divided on the same terms as proceeds of lands set out in paragraph Three of this will. Item Five. I will and direct that my executor hereinafter named be authorized to sell my stocks and bonds at public sale (if my heirs at law cannot agree on a private sale) and that the proceeds be divided on the same terms as proceeds of lands set out in Item Three of this Will. All money on hand be divided in same manner. Item Six. I give my gold watch to my son John W. Chapman, same not to be counted against his share of my estate. Item Seven. I will and direct that my household furniture be equally divided among my heirs. Item Eight. I nominate and constitute my beloved son, Augustus H. Chapman the Executor of the Will, and I confer on him power as such Executor of to wind up my estate without giving bond, filing Inventory and appraisement or making Annual Returns to the Court of Ordinary unless same be absolutely necessary. In witness whereof, I have hereunto set my hand this the second day of February 1923. John H. Chapman Declared, published and signed by John H. Chapman, as his last Will and testament, in the presence of the undersigned as Witnesses, he first signing in our presence, and we then at his special instance and request, signing in his presence and in the presence of each other.
