Written: December 5, 1825 Recorded: April 11, 1826 Writ of partition to Divide Personal estate of James Martin. Recorded 11 April 1826 (6?) Georgia Columbia County In the court of ordinary December 5 1825. To Benjamin Leigh, David Stanford, James Cartledge, Hezekiah Magruder, and Edward Wooding, Esquires Greeting. Whereas Robert Martin administrator on the Estate of James Martin dec. has applied by petition to this court for an order thereof to cause the personal property of said estate to be divided amongst the heirs ______ of the estate of the said James Martin deceased and no person gaining the same. Ordered that you the said Benjamin Leigh, David Stanford, James Cartledge, Hezekiah Magruder, and Edward Wooding or any three or more of you go to and upon the premises of said estate or other convenient place giving Robert Martin administrator as aforesaid due notice of your said meeting and you the said Robert Martin administrator as aforesaid are hereby required to produce and lay before the said commissioners each and every the personal estate that may have come into your hands as administrator aforesaid at the time & place of their said meeting, and you the said commissioners are hereby required to notify the said heirs of the time and place you appoint to make distribution of said estate to be present if they think fit so to be and then and there make distribution of all and singular that personal estate of James Martin deceased which may be laid before you by the said administrator (first taking & subscribing the oath hereunto annexed in the following manner to wit. To Owen West who intermarried with Elizabeth Martin an heir of said estate one ninth part of said Estate. To James Martin an heir of estate one ninth part thereof. To Tandy Martin an heir of said estate one ninth part thereof. To Leonard Martin an heir of said estate one ninth part thereof. To Thomas Martin an heir of said estate one ninth part thereof. To John Sutherland who intermarried with Hannah Martin an heir of said estate one ninth part thereof. To Samuel Kendrick who intermarried with Ann Martin an heir of said estate one ninth part thereof. To Thomas Harrup who intermarried with Sarah Martin an heir of said estate one ninth part thereof and To Robert Martin an heir of said estate one ninth part thereof in shares (?) as directed by the statue in such case made and provided, all which property to be held separately and in severally (?) so that neither of the said heirs shall have more of the inheritance thereof than to them is right belongeth, and the said distribution or partition by you to be made distinctly and openly by Lot (?) or otherwise under your hand and seal and have given before the judges of the court of ordinary to be held in and for the county aforesaid on the first Monday in March next also this writ. Witness the Honorable Isaac Ramsey (?) one of the Justices of said court this 7th day of December 1825. P. Crawford, clerk Commissioners Oath We the commissioners named in the annexed of distribution and herewits subscribing our names being severally and respectively duly sworn maketh oath and each for himself swearing he will make division and distribution of the personal estate of James Martin dec. amongst the heirs named in foregoing writ according to Justice and equity without favor or affection to any of the parties to the best of your skill and understanding. Sworn to and subscribed before me the 28 December 1825 James Cartledge, J.P. David Stanford, James Cartledge, H. Magruder Return of Commissioners We David Stanford, Hezekiah Magruder, and James Cartledge, Jr. by virtue of a writ of distribution to us directed after being duly sworn ________ by law before we entered upon the execution of said writ and having also warned the several parties agreeable to direction of said writ to be present if they see fit so to be, and after d ue and mature deliberation being had upon all and every the premises laid before us by virtue of said writ of distribution and the statute and such cases made and provided we have distributed the said estate in the following manner that is to say we hereby assign and deliver over to Owen West who intermarried with Elizabeth Martin an heir of said estate Lucy, Alethia, and Eoy and pay to Tandy Martin forty-five dollars and pay to James Martin twenty-seven dollars and to John Sutherland twenty-three dollars. We do hereby assign and deliver to James Martin an heir of said estate a negro man Dave and a boy Cyrus and to receive from Owen West twenty-seven dollars in money. We do hereby assign and deliver over to Tandy Martin an heir of said estate a negro man Ned and to receive from Samuel Kendrick one hundred and twenty-two dollars and to receive Owen West forty-five dollars and to receive from Robert Martin ten (?) dollars. We do hereby assign and deliver over to Leonard Martin an heir of said estate a negro man Hall and Lena and to receive from Robert Martin two dollars and twenty-seven cents. We do hereby assign and deliver over to Thomas Martin an heir of said estate two negro girls Sally and Hannah and to receive from Robert Martin twenty-seven dollars. We do hereby assign and deliver over to John Sutherland who intermarried with Hannah Martin an heir of said estate a negro man Lewis, Judy, Charity, and Susan, and to receive from Owen West twenty-three dollars and to receive from Robert Martin three dollars. We do hereby assign and deliver over to Samuel Kendrick who intermarried with Ann Martin an heir of said estate Philip, Jane, Austin, and Rebecca, and an infant and pay to Tandy Martin one hundred twenty-two dollars. We do hereby assign and deliver over to Thomas Harrup who intermarried with Sarah Martin an heir of said estate a girl Rebecca and boy Dick and receive from Robert Martin twenty-seven dollars. We do hereby assign and deliver over to Robert Martin an heir of said estate a man Wally and Anarchy and child Wally and to pay John Sutherland three dollars eighty-five cents and pay to Thomas Harrup twenty-seven dollars, and pay to Thomas Martin twenty-seven dollars, and pay to Tandy Martin ten dollars, and pay to Leonard Martin two dollars seventy-seven cents. All which personal estate in form aforesaid, parted, divided, assigned, and delivered are all the personal estate of James Martin deceased as shown us by Robert Martin administrator on said estate. All which we certify to the honorable court of ordinary of the county aforesaid within the term ___ in obedience to the _____ of the annexed writ. Magruder Additional Comments: Sarah Martin was born ca. 1768 in Virginia and was the daughter of James Martin who died in Columbia County, Georgia ca. 1825. It is believed that Sarah died between 1850 to 1860. She married Thomas M. Harrup/Harp in Columbia County, Georgia on October 16, 1793 or October 16, 1799 (both years are listed under Martin & under Harrup) in the Index to Marriage Bonds in Columbia County, Georgia.
