Toole of County of Columbia} county and state aforesaid for and in consideration of the sum of five dollars cash in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged as well as for the better securing the payment of certain promissory notes that the said John M. Toole to certain persons herein named and to which said notes Richard R. Harrison has stood security the notes as follows: Seymour and Ausley due 1st February interest from 1st January 1852 for one hundred and eighty dollars, H. W. Massengale and Co. for forty six dollars 21c due 1 January 1852 interest from date. Thos H. White and Co. eighteen dollars 31c due 1 January 1852 interest from date. James C. Pearce fifty one dollars 37 c due 1 January 1852 interest from date. A. F. Candler? anw? for thirty seven dollars 19c due 1st January 1852 interest from date. Edward Harrison for forty dollars due 1st January 1852. One ditto Edward Harrison for fifty dollars due 1st January 1853. 1853. Joseph Harden? for thirty seven dollars seventy five cents due 1st January 1852. James Wade eighty two dollars thirty nine cents due 1st January 1852. One Jesse S. Walton for twenty dollars due 1st January 1852 whereby the said John M. Toole promise to pay the said holder of said notes or barer (bearer?) the said sums of money for value earned has bargained and sold to the said Richard R. Harrison the following property to wit a certain negro boy named Jim of yellow complexion Ten years of age about three and a half feet high also a negro boy named Henry of yellow complexion 3 years of age To have and to hold the said bargained property to him the said Richard R. Harrison his heirs and assigns forever. And I the said John M. Toole for myself my heirs executors and administrators the said bargained property unto the said Richard R. Harrison his heirs and assigns against my heirs? executors administrators and against all and every person or persons whatever shall and will warrant and defend by these presents. Provided nevertheless that if the said John M Toole his heirs executors, administrators shall and do will and trust or cause to be paid unto the said holders of the notes named in this instrument the aforementioned sums of money in the days for payment thereof with lawful interest on the same according to the time of said notes then and from thenceforth as will this bill of sale and the right of property thereby conveyed on the said promissory notes shall cease determine and be owed to all intents and purposes. In testimony the said John M. Toole hath hereunto set his hand and affixed his seal April 14th 1852. Signed Sealed and delivered in John M. Toole {seal} the presence of John H. Scott James B. Wilson J. P. Transcriber's note: As I understand this, Richard R. Harrison is assuming responsibility for these "notes" or debts owed by John M. Toole. In exchange John M. Toole has given Richard R. Harrison two young negroes. The five dollars paid by Richard to John Toole is simple legal consideration which must exist to make a contract. If anyone else can offer insight into the understanding of this deed, please contact me. Richard R. Harrison is listed on the 1850 census of Columbia Co., GA as 36 years old and married to Harriet. It is speculated that Harriet's maiden name is Toole. Her relationship, if any, to John M. Toole is unknown at this time (Jan 2003). The total sum of the "notes" in this deed was $563.22.
