This file was contributed by: Pattie Causey pacausey@mindspring.com ==================================================================== JOHN AVARY (1827) "Georgia Columbia County Be it Known to all whom these presents may be made manifest that I john Avary of the county and State afore said do make and ordain this my last will and testament whereby I give and dispose of all my property the following maner Vz Item 1st It is my will and desire that all my just debts shall be paid and for that purpose I wish the tract of land with all the improvements sold to the highest bider or as my executor may think best I also wish my negro woman Poll and her child sold to the best advantage as my executor may think best. also my negro woman Peggy and all the stock that can be spared I also wish the side Board and Table & ends? and as much of household stuff as can be spaired; the money ariseing from the sale of the above named property I wish applyed to the payment of my debts as soon as practicable; Item 2d It is my will that the ballance of my property shall be kept together untill my Two daughters shall arive to the age of Twentyone years or the youngest shall marry The eldest Elizabeth and the youngest Phebe. Then in that case I wish all of my then may exist from any sorce what ever to be equally divided between my wife Nancy Avary and my two daughters share & share a like if my! wife shall live till that time, and if she should die sooner, the whole to beEqually divided between the two named daughters if both are living if Either should die before they arive to the age of twenty one or should die without a legal heir the whole to go to the surviving one. Item 3d It is my will that my wife have one hole one third of all my property so left after all my just debts are paid during her natural life, and at her death all of that part that may be left to go to my two daughters before named or the surviving one of them, Item 4th It is my will that the Ballance of my negroes shall be hired out yearly for the purpose of supporting the family and schooling the children, untill they arive to maturity or marry Item 5th and last I do nominate and appoint William Jones and Archer Avary my Executors to this my last will and testament In Witness whereof I do hereunto set my hand and affix my seal in presence of Wm ?
