AVARY "State of Georgia Columbia County In the name of God, amen. I phoebe T. Avary being of Sound mind and memory, do make and ordain this this to be my last will and testament, hereby revoking all other wills heretofore made by me. Item 1st It is my will and desire that the whole of my estate real and personal be held and managed by my Executor hereinafter named, for the following uses and purposes: viz: that my following named grand children Phebe T., Mercy I., William Madison, and Irine S. Flanigan be supported and mentained, and given a common English Education, until they become of age or marry; Provided that their Father James T. Flanigan will consent to give the guardianship and control of said children to my Executor hereinafter named, but if said James T. Flanigan shall take control of said children, after my death, my Estate is in no-wise to be charged with the Support and Education of said children. Item 2nd It is my will and desire that each of above named children, Phoebe T., Mercy I., William Madison, and Irine S. Flanigan be given from my Estate by Executor hereinafter named, one hundred acres of land, one horse, one cow & calf and one bed & beding, as they become of age or marry Item 3rd It is my will and desire that should any of my above named grand children die before becoming of age or marrying, or die after becoming of age and leave no child or children, the property, both real and personal, herein bequeathed to them shall revert to my estate. Item 4th It is my will and desire that the whole of my estate remaining after the foregoing bequests shall go to, and absolutely vest in, my son Charles B. Avary also all reversions shall go to, and vest in him. Item 5th I hereby nominate and appoint my said Son Charles B. Avary my Executor to carry into effect this my last will and testament and authorize him to receive my Estate as it stands at my death and manage it as he may think best for the foregoing purposes.
