I William C. Avary of the County of Columbia and State aforesaid, being of sound mind and disposing memory do make and ordain this to be my last Will and testament hereby revoking and annulling all former Wills or Testaments by me heretofore made. I desire my Executor hereinafter named to pay all of my just debts as soon as the same can conveniently be done after my death Item 1st I give and bequeath unto my beloved Wife Elizabeth Avary, one tract of land in Early County Containing Two hundred and fifty acres to dispose of as she may choose. I also give unto my Wife a Comfortable Support and maintenance out of my Estate during her natural life or as long as she may remain my widow. - I also loan to my Wife Elizabeth as long as she remains my widow whatever portion of property money or effects she may receive from the Estate of her father Charles Clay dec'd - and after her death or intermarriage the same to be equally divided between my two sons William A. Avary, Richard Avary and my two daughters Polly Tankersley and Nancy Dougherty share and share alike, the child of a deceased parent to take the place of such deceased parent. Item 2d I have heretofore loaned to my daughter Polly Tankersley a negro woman named Tile who is now the mother of four children to wit Clarissa, Sam, Nancy and Nathan and have heretofore given my said daughter Polly sundry articles of Bedding & furniture and other necessaries for house keeping - I now give and Confirm unto my said daughter Polly and the Children born or that may be hereafter born of her body the negro woman Tile and her aforesaid Children with the future increase of the females to her the said Polly Tankersley and her Children forever - also one half of three tracts of land which I own in originally Wilkinson County - the other half of said tracts of land I give to my daughter Nancy Dougherty Item 3rd I give and bequeath unto my daughter Nancy Dougherty Wife of James Dougherty one negro fellow named Bob one horse saddle and bridle and two beds and furniture which she already has in her possession - I also give unto my said daughter Nancy one half of three tracts of land which I own in originally Wilkinson County, the other half being already given to my Daughter Polly Tankersley. Item 4th I give and bequeath unto my Son Richard Avary a negro fellow named Alfred and Sundry articles of personal property heretofore received from me. - And One half of the tract of land on which I now live to be divided between the said Richard and my son William A. Avary Item 5 I give and bequeath unto my son William A. Avary his choice of any one negro I possess two beds & furniture two Cows & Calves & two horses or mules which I may die possessed of Together with one half of the tract of land of five hundred acres on which I now live Item 6. I desire my Executor to retain in his hands not subject to division all of the proceeds of the sale of my perishable Estate as a fund to be drawn upon for the comfortable support of my Wife while she remains my widow and the remainder of said fund to go to my son William after the death or intermarriage of my Wife. Item 7th After the foregoing provisions are Carried into effect and all of my just debts are paid - I Will and desire that the balance of my negroe slaves be equally divided between my sons William A. Avary, Richard Avary and my daughter Nancy Dougherty - Lastly I do hereby nominate Constitute and appoint my son William A. Avary my sole Executor to carry this my last Will and testament into effect. In Witness whereof I have hereunto set my hand and seal this Nineteenth day of April 1848 Erasures & interlineating made before signing.
